Thanks to the ruling which found the New York State registration and decal tax to be unconstitutional, some truckers can now expect to get a part of a $44 million refund agreement brokered by the Owner-Operator Independent Drivers Association.
OOIDA’s battle against New York State ended at the state Supreme Court in January of this year, but truckers have yet to see a dime returned to them. New York has been negotiating with OOIDA to determine who will be beneficiaries of the class action ruling and what they will receive.
Under the current program, all eligible class members will receive a “virtually complete tax refund, plus interest, subject to attorneys’ fees, based upon the state’s reapportionment of the taxes in conformity with constitutional criteria.”
Some large carriers have already filed their own lawsuits to get their money back. Prime Inc. sued New York State looking for almost $500,000 to be repaid which they lost to the repealed taxes.
The OOIDA negotiation will mean that small carriers, owner-operators, and even owner-operators driving for a larger carrier will see the tax money returned with interest.
Once the deal has received final court approval, a class notice will be published and OOIDA will be keeping class members informed of any further developments.

This is great news. As a small fleet owner, I can expect to pay anywhere from $250-$1000 per quarter per truck to the NY state tax department for HUT. As a result I do my best to keep my trucks out of New York State. It really is a terrible burden, we pay a fuel tax, apportioned plate fee, HUT, Toll Road fees. Where does it end. However, the HUT in NY state is the biggest one, it is definitely time to be reigned in. I doubt it will be though.

“Subject to attorneys fees” means we’ll probably get a check for $3. 44 million minus fees divided by all the trucks w/ HUT stickers on them doesn’t amount to much. New Mexico and their “permits” should be on the list too.

Amen. Nobody wins in court except the attorneys, and it’s the attorneys who write, adjudicate, and argue the legality of these laws, in the first place. So one lawyer writes and gets and illegal law passed, and another one sues, and makes money off of the other’s mistake. They never take one another’s money, however – just everyone else’s… :-/

I was just told 2 weeks ago by a NY state trooper that the ruling was overturned and we have to keep out HUT sticker updated and paid for. Well which is it?
