Insurance claim question

    Absolutely no luck here. As my loss control guy feared, they are refusing to pay the claim. because I left my door open while I closed the trailer doors they say their driver is not at fault. Even tho he had a football size area to move around, made a bad decision to blindside into the space between me and the closest truck to me (an area you could put 2 trucks in) and would have hit my truck regardless, and he really didnt even need to move into?, and he only stopped because I screamed at him. They know it isn't worth us hiring lawyers in the US to sue over a $6500 claim, so screw the Canadien, so now my insurance kicks in, me paying the first $5k deductable. Sorry for the rambling nature of this but I'm so mad I can barely see.

    You'd get legal fees on top of your claim.

    Claim is $6000 Ish when you back the taxes out. Deductible is 5k not much incentive for my company to proceed. I will have to do it on my own. Not sure if I have to file in Oklahoma where the accident happened or home state of his insurance company?

    No idea about Canada insurance. But in the states there is an organization called the national insurance commission. It is state by state. My old neighbor worked there, my dads truck got hit and the driver had a shady fly by night insurance company. All it took was my neighbor giving dad a phone number, dad called. Next day an adjuster was at the house writing a check.
