    You own the truck, and went 50/50 with a hired driver? By "loads" you mean "loaded miles," right? Man, that's not a good ratio, for you. Who was paying the truck? Was it 50/50 after the truck/insurance/tools, scales, turnpikes, and "miscellaneous?" Rollover for speed is an at-fault collision....was the driver ticketed? I own a truck, and the biggest hurdle to expansion is exactly what you posted - finding a driver who won't roll my truck. Or worse. Best.

    Anything you do that may seem fair to you may not be in a court of law. Id talk to a lawyer before you make any moves because it may come back to bite you in the butt at some point.

    Why not charge him for the tires. Measure the tread depth, and send a pro rated bill. This just sounds really silly on all points. This would fail badly in court. Just let it go.

    The EPA clean up fee will tell you how much fuel was in the tanks,most of it is gone?

    Depends on the paperwork, the contract u and your driver agreed upon in writing. Then if so, a 50/50 deal was agreed to, then since it's in your favor, u have to make a moral decision that's completely up to you. :)
