I have heard some O/O talking about some new rules in Chicago. From next year if you lease your truck to a company that is going to dispatch it, you must have a company, no more contractor on 1099 form.
Anybody knows more details ?

I heard that if you drive as a company driver in a company truck,.. being 1099 is a bad idea with potential fines to the company owner. As long as you pay your taxes,.. IRS cant do anything to you as a driver under 1099. Its the 'Carrier' taking the risk.
But as an O/O,.. they cant stop you from being 1099 contractor as long as your buying your own fuel, loads are not force dispatched, and your pretty much doing your own thing.
I had a learning curve to really understand what and how 1099 works. I was pretty ignorant about it for a long time.

They are Russians, Bosnians, and Polish immigrants dodging this Countries system and their obligation to pay taxes like the rest of us have to.
It screws us all in the end. It screws the driver out of funds that are supposed to be 'credited' as contribution to Social Security. At the end of the year YOU won't get away with not paying your taxes...so how do THEY get away with it.
Enough is enough with these freaking clowns...they need to learn the rules (and English by the way), and contribute to the system by paying their fair share.
You know....everybody wants to come here (America) and get rich, and be free...but they don't want to follow the rules. It is time they learn, or pay the consequences. And by that I mean DO IT RIGHT or get the hell out. I am sick of them.
My last check? The Government took more money than the net pay of someone making $11.00 an hour on a 40 hour week---and it pissed me off to know end. BUT I PAID IT, and had no choice in doing so.
I'm not sure what kind of "deal" the Government gives to migrating Bosnians in my area...but there are LOTS of them, and they buy a truck or two, or three once they come here (how I don't know), and then the trucks sit in Waterloo, IA. at the Casey's truck stop on Hwy. 20 & 63 or at the Flying J and Pilot at exit 68 (Evansdale/Elk Run Heights)---go into these places and see for yourself---if it says "Waterloo, IA." on the door under their company name, it is a Bosnian owned truck, and will sit there taking up space for weeks and months at a time. And there are a LOT of them.
Fishy if you ask me. Makes me think the Government has given them money to start a business...and then don't require them to show a profit, and they use the business as a Government sponsored Visa into the country...and then go work at Tyson or something, and leave the truck parked.

The question was about the owner operators, not the company drivers. As an owner operator with my own truck I used to lease my truck to a few different companies in Chicago and every time was by 1099 form. From next year if they require you to have a company, you may get an authority as well and start dispatching your self. If this is the case, then our government wants you to make a choice, be a separate company or sell your truck and become a company driver.

A 1099 is for reporting annual earnings to the IRS.
To lease a truck to a carrier a lease contract is required.
