Forced Into Trucking.....Kind of

    I have had an operating authority for 3 yrs now but not a driver. I wanted to know what the risk are for allowing someone to operate under the authority and what the risk maybe ?

    At fault fatality wreck. And all the lawsuits that follow.

    You become fully responsible for all of their actions as if it was your own truck and driver, so there is a great risk involved. Some states even require you to carry workers comp on contract employees, so there are a lot of things to think about. I am not saying don't do it, just understand that you are the one that will be responsible for any citations, fines, etc that are directed against the company. You are also responsible for all the operational things like drug testing, DOT audits, maintaining full insurance to keep the authority active, any actions from shippers or receivers for a cargo claim. Unless you are making enough to make it worth the risk I would not do it, even if it is to help a friend, especially if it is to help a friend. Simply put, if they can afford to do it right while working under your authority then they can afford to do it right on their own, or put the other way if they can't do it right on their own they won't do it right when someone else is responsible.

    You can research a drivers history. That isn't a window on the future, but past performance is pretty good as an indicator. I think about adding a truck, or two, all the time, and for me finding a responsible, on-time driver who'll take care of my truck is the hardest of all the elements. Best.
