Does any one know how to find out the rights for owner operators. My husband worked for Giltner and in 4 months he only brought home maybe $3,000. We figured his 75% cut would of been close to $60,000 and like i said he only got $3,000. He was leasing a truck from them, only reason he gave up his truck was his truck could not go through Canada (he was promised loads to Alaska, so thats why the leasing through Giltner). Now his last paycheck should of been the 9th Of Dec. and they are trying to double charge him for a fender (someone backed into him) they already got the check from the insurance company. So what i need to find out where do i go to have this company looked into? If anyone knows what we should do please respond.

If his "cut" was gonna be 60k in 4 months with someone else's truck I would would like some of that action please

I don't know if the 'full disclosure' that applies to broker arrangements with carriers and o/o's applies in the case of lease arrangements. 'Full Disclosure' basically means that a carrier has the right to request all info regarding a load including amount billed to the shipper and breakdown on the payout to the carrier. -

What does his leasing agreement state Re. deductions etc.?
Did you/he actually read & understand the lease before you/he signed it? If you didn't, did you take it to an attorney for an interpretation of the agreement?
I've stated many times in this forum that is the largest problem with lessor/lessee agreements (signing before reading & understanding). People sign leases & for all they know the lease could say that he/she must stay leased for 5-years & if you don't they get the truck (yes, I know you were leasing the truck but I use this as an example).
I apologize for being frank, and I'm terribly sorry for your losses. Perhaps you should seek out a good attorney that understands contracts. As a business owner you, and your husband need an attorney on retainer anyway.
