If the drivers made him aware of issues and they went uncorrected then he SHOULD be charged and yes, that kind of accountability should be brought here.

If the driver was aware of the situation why did he even drive the truck???Always looking to blame someone else.

I agree... This is just passing the buck to someone else.. The guy didn't die because the Owner-Operator failed to fix the truck, the guy died because he failed to PARK the truck and not drive it knowing that the brakes were bad... Should the company be somewhat responsible for the accident, I suppose to some degree he should because he failed to get the issues fixed.. BUT remember the ultimate responsibility is on the person driving the truck... If he did a circle check and marked off the brakes were good then he lied on Pre-Trip, If he marked on his sheet they were bad then he shouldn't have been driving it in the first place...

People need to take responsibility for their actions rather then trying to blame someone else... Still sad that a driver died because of this...

In the states you refuse to drive the truck and you could get fired or considered a voluntary quit. Apply for unemployment and you will be denied unless you have a witness, good luck finding a coworker willing to testify against the boss!

ETA; a lot needs to change

Does anyone truly believe a TFW or new driver is going to park a truck and walk away. Probably not.

Judging by some equipment duct tape a few strands of wire with a bit of hope and prayers thrown in and it's good to go... If it ever breaks abandon it and buy a new beater their are a lot of trucks at tow facilities that they abandoned instead of paying the tow bill after ditching it

I'm pretty sure the year was 2005. On morning X a driver told his boss he refused to drive a certain truck because of the shape of the brakes etc. Boss told driver to take the day off ..... and not come back. Lesson learned by other drivers. On morning Y, same truck, different driver heads out. 1 hour later said truck's brakes fail. Truck plows past a school bus and into a mini van killing 3. Accident happened in Brookfield, PEI on highway 2. I tried to Google more info, but came up blank.

    It's the same old story.

Most scales/dot guys will ticket the company if you (the driver) take the truck to them or call them to inspect the unit, but most people are too scared to refuse to drive junk

I wouldn't work for a company that did not respect the lives of their drivers of other people on the road.

The shiftwork we are doing for the mill borders on being irresponsible, but that lies with the driver....take the load if you are rested well enough, don't if you're not.
