I've never used this provision. Can one actually log 16 hours of work/ driving on day 1 and make up the 2 hours off duty on day 2?
Is this correct:
Day 1:
13 driving
3 on duty
8 off duty
Day 2:
11 driving
1 on duty
12 off duty.

I have never used this provision, but it appears it is legal .. I am thinking how it works is you use up your 14/13 as fast as possible, eliminating the 16 hour window, know what I mean? -

The example shows 14 hours driving and 2 in duty on day 1, but the driving doesn't exceed 13 hours at once. So....it looks like the 13/14 hour rule per shift still applies but if you sleep sometime where it doesn't begin or end at midnight, you can continue to work/ drive in day 1. -
Sleeper split - 4 on 4 off 4 on 4 off 4 on 4 off etc etc

Okay, here's the section of the Act...
And here's the applicable content from the CCMTA "Commercial Vehicle Drivers Hours of Service Regulations Application Guide" (can be referenced similarly as the FMCSA "Guidance" in the U.S.)...
So, in simplest form, You can't extend you 13/14, but you can work/drive an extra 2 hours in a day so long as you take 8 consecutive off. Then your 2 deferred hours get attached to Day 2's 8 consecutive off so now you have to take 12 hours off which can be split 10/2.
From your op, you would be in violation as you are over 14 hours total of driving + on-duty if all taken consecutively as shown. You are only deferring your off-duty time, you cannot extend your 13/14 with this provision. You can extend the 13/14 under the "adverse driving conditions" provision.
I used to use the deferral a lot. A few years ago I was on a pipe haul that was M-F and I would use Day 1 on Thu. and Day 2 on Fri. In that case it didn't matter because I was off-duty more than 36 hours, but it's good to note (as stated above) that you do not have to add the 2 deferred hours to your 36 if you are taking a reset. I have used that quite a bit as well. -
That's helpful. It seems the most advantageous time to use the deferral is the day before a reset.

They gave us the deferral and took the 4 hour self inflicted torture provision. I used to use that Fridays, on my third Vancouver to Prince George rounder of the week. I may have gotten home 4 hours earlier but I couldn't get my carcass off the couch the rest of the weekend.
