A Chatham man who blew over three times the legal limit of alcohol in a breath test has received a $1,000 fine and a one-year driver’s licence suspension.
The defendant, Craig Alway, 37, challenged the actions of the arresting police officer, claiming that he was not promptly informed of the reason for his detainment on Oct. 6, 2007.
Alway’s lawyer, Brian Ducharme, argued that his client had not been informed of the reason for being pulled over before he was asked to step out of his car by police.
Assistant Crown attorney Fred Creed said a Chatham-Kent police officer witnessed Alway turn from King St. onto William St. around 3 a.m.
His driving was described as “erratic.”
Creed said Alway was seen weaving on the road and had to “abruptly” pull away from the curb several times.
When the officer activated his emergency lights, Alway did not pull completely off the road and the officer had to pull in front of the vehicle to stop the driver.
Police reported the odour of alcohol on Alway’s breath as well as from within the vehicle.
Creed said upon stepping out of the vehicle, Alway leaned against his vehicle to steady himself and was swaying.
Ducharme told the court that Alway had an injury to his left leg, causing him unsteadiness on his feet. http://www.chathamthisweek.com/News/400487.html | |
