If this is true, than there is a problem, define enforcement.

State House Majority Leader Pete Schwartzkopf (D-Rehoboth Beach) successfully sponsored a complimentary measure (HB 493) to exempt two-way radios used by delivery and service trucks, as well as those utilized by state workers. (Quoting from 2011 news article above)

This would provide the loophole needed by truckers. It further proves the point that the 2 way radio is NOT a major contributor to accidents. It also shows that such laws are hypocritical and STUPID. If it WERE dangerous, then it would be just as dangerous for fat-bellied Bubba cop or the state's utility workers, or delivery drivers to use them. The actual truth of the matter, 2 way radios are NOT a contributor to accidents, and the historical use of millions of CB radios in the 70's proves it! It is nothing more than a revenue-generating scam to lump 2 way in with the cellphone which DOES tend to distract drivers. SO! The loophole is, truckers use 2 way radios to deliver products. DUH! A CB IS a 2 way radio. It is licensed by FCC. It is CONTROLLED by FCC. It has historical precedent for mobile operations. If amateur radio is recognized for its proven disaster and emergency relief, then a CB CAN, in many cases, be used for the same thing. It. however, and like amateur radio, IS governed by FCC. Using these historical precedents, the current prohibitions by Delaware, I think, can stunted.

These stupid little b****rds with a 2 digit IQ expect us to simply roll over and play dead. I know its not possible, but wouldn't it be something if, suddenly trucks began to shun Delaware, and their grocery shelves start getting bare? Now THAT would get their attention.:biggrin_2559: They *might* ticket you for using your radio, but they can't MAKE an independent trucker come TO Delaware!!!

As you have guessed, I am just as passionate about THIS as I was about (and still am) the 10 Meter issue (CB ops coming up onto 10 Meters without license). When something is RIGHT, it is RIGHT: When its WRONG, it's WRONG. And this targeting of legitimate users of 2 way radio with a straw man argument that it "causes accidents" is just WRONG!

I have completed the petition, but haven't got it copied. There's 9 copies going to 9 Commissioners + 5 pages of Docket 91-36 X 9 again! All must be copied, multiple cartridges of ink bought, packaged and shipped to FCC where I hope to have a positive Declaratory Ruling on this issue based on current law and precedent. In addition to amateur radio, I am wording my Plea to include CB radio and commercial 2 way as well!

Laws are intended for good and to promote an ordered and safe society. Sometimes little p*ss ant, do gooders with an "authority complex" and other nefarious motives simple go TOO far: they simply don't KNOW any better!

There is NO reason for these clowns to do this and it must be stopped! We've got TOO many laws already!!!:biggrin_25511::biggrin_2558:

Again if I remember correctly the guys causing interference to other forms of communication where the target such as people watching tv etc would feel Bill Clinton's pain, however if a state were truly trained they could check your station out with a watt meter it was their call.
Many ham operators would gladly train local law enforcement officials free of charge but many of them run illegal stations too and if they got caught they would lose their license to operate ham radio's.
Many local jurisdictions just don't have the time nor the manpower and they still refer people to the FCC.
