Advertising, selling, cursing, "commercial company" etc etc etc............. Yes it's all illegal. Will it stop? NO. If you complain to the fcc will it help? NO, ( for already said reasons ). I could care less except for the "language". My kids travel on the road with me in the summertime especially and they like to talk on the radio to other people as i did when i was a kid riding with grandpa but i usually won't even turn it on anymore when they are with me because of all the fowl mouths out there calling each other racial names or f this and f that.

I can hear the aluminum polishers in Eloy AZ plain as day in Denver pretty often lately, the FCC should go give them a talking to. If they worked as hard on the polishing as they did on the radio, word of mouth might take the place of having to broadcast their advertising every 45 seconds all day long.

Gadfly,

Proof that although the FCC is underfunded, and understaffed, they do still pay attention to the CB. It'll be interesting to note the final decision ($$$$$)on this matter.

CERTIFIED MAIL RETURN RECEIPT REQUESTED

May 1, 2009

Mr. Daniel Little

Morenci, MI

Re: WARNING FOR UNLICENSED RADIO OPERATION

EB-09-GB-0103

Dear Mr. Little: It has come to the attention of the Federal Communications Commission that at multiple times in the last several months you have operated overpowered transmitting equipment on 11 meters that has interfered with the operation of electrical devices by your neighbors. The Commission's rules require that you operate your CB station with an FCC certified CB transmitter. The rules also prohibit the use of external radiofrequency power amplifiers (sometimes called linears or linear amplifiers). The rules further provide that use of a non-certified CB transmitter and/or power amplifiers voids your authority to operate the station. Operation of radio transmitting equipment without a valid FCC authorization is a violation of Section 301 of the Communications Act of 1934, as amended, and may subject the responsible parties to substantial monetary forfeitures, in rem arrest action against the offending radio equipment, and criminal sanctions including imprisonment. Because unlicensed operation creates a danger of interference to important radio communications services and may subject the operator to severe penalties, this warning emphasizes the importance of complying strictly with these legal requirements. UNAUTHORIZED OPERATION OF THIS RADIO STATION MUST CEASE IMMEDIATELY.

You have ten (10) days from the date of receipt of this warning to respond to this office. The response must contain a statement of the specific action(s) taken to bring your CB station into compliance with the Commission's rules and should include a time line for completion of pending corrective action(s). You are directed to support your response with a signed and dated affidavit or declaration under penalty of perjury, verifying the truth and accuracy of the information submitted in your response. Your response should be sent to the address in the letterhead and reference the listed case number. In an inquiry of this type we are required to notify you that under the Privacy Act of 1974, 5 U.S.C. S: 552a(e)(3), the Commission's staff will use all relevant information before it, including information you disclose in your reply, to determine what, if any, enforcement action is warranted in this matter.

You may contact me at 717-338-2577 should you wish to discuss this matter.

Sincerely,

Laura L. Smith

CB Shops and rib shacks have been advertising on the cb radio since the dawn of it's existence. Rarely do you hear them outside of the local area, but, I too have been hearing them from several states away these days. Since the FCC could care less about what happens on the CB radio anymore, since it is considered and out dated technology, like the 8 track tape, people are hurting in the economy right now and they need some sort of additional outlet for advertising to keep the family fed and roof on the kids' heads I guess.

Locate this guy, and I'll bet you he transmitting near a government or military installation, that's the only time the FCC cares to "Good Ol' Boy Hunting"
