per diem question

    I've noticed in other areas of the forum discussions re: per diem - my question is - does Central give you the option of per diem? Can we say yes we want it or no we don't?

    It looks like from the Central Employee Manual, that we don't have a choice in the matter....
    When/if we have a face to face with payroll I'll ask the question. I have a few other questions that I would like to get answers for too...

    You have no choice. .08 CPM of your pay is perdiem.
    Which is fairly low, so you will still have a good bit left at the end of the year to claim on taxes.
    The .08 makes it so that your net is almost equal to your gross on your pay checks.

    I personally don't see anywhere in any law that states a company is allowed to mandate Per Diem. I would have to get a lawer to confirm this but I ask this question in regards; If it is so good for the employee, than why is it mandatory? At the company I work for now, they sold the per diem idea to me at first, until I did my research and realized they were charging me 2 cents per mile for the pleasure of paying me my money... It took me 3 months to get off of it, but I did and will never get back on it. If a company mandates it, I will either take them to court or just not drive for them. It is bad enough that the Goobermant messes with our EARNED money, let alone companies that we work for.

    At least Central does not charge you to take it I guess.
    Maybe that is why they make it mandatory. It is just how they have their pay package set up.
    I personally rather not have the payments from the company. I like being able to claim the full amount at the end of the year. But that is just me.

    per diem is non-taxable, so .08 cents out of 28 would work for me, as long as the company does not charge ya for it

    No charge.
    And if you itemize you can still claim the rest of the perdiem you are owed. Since .08 is not going to add up to 80% of 59 bucks a day.

    Hola from cali., where does the $59 a day come from, the tax code?, lots of $$$ to be saved in doing taxes correcrtly...appreciate all the help on this blog very much thanks

    It is the rate that the fed's decided was proper for people that fall under federal hours of service rules.
    It is for use on your federal taxes. You count all the days that you were away from home for your mandated 10 hour break. Then multiply those days by 59 bucks. Then you can deduct 80% of that.
    For teams both team members can make this deduction.
    So if you are a husband wife team and you are out 250 days that is. 250x 59 x 2 x .8 which equals a 23,600 dollar deduction.
    Then if you own your house and can deduct interest etc. You have even more.
    Plus things all the little things needed in the truck. You can find a list of those around here somewhere.
