    yeah that's kinda what we figured so looks like he won't be there long..I thought maybe they were just giving us the run around so I don't quit on the van side but guess not..thanks for the reply..

    Thought i might post one of CRST Malone's New Company Policies

    SUBJECT: CSA CORRECTIVE ACTIONS

    In recent months, extensive efforts have been made to reduce our CSA scores at CRST Malone. For the last several months, education and communication efforts have targeted the importance of these issues. Contractors must understand that specific behaviors are causing these violations. In order to improve our results, the following actions are implemented. This update reflects additions and changes to those identified from the July 24th, 2013 notice.

    Note: If contractors receive violations in the areas listed below and choose to challenge the violations in court, contractors must obtain a verdict of “Dismissed with Prejudice” or be exonerated with a verdict of “Not Guilty”. Once this has been accomplished, CRST will challenge the violation through the DATA Qs process. If successful, the contractor can apply for reinstatement as an independent contractor with CRST Malone. If the original charge(s) were reduced and a contractor pleads guilty to a lesser charge by paying a fine, the cancellation of contract still stands. This will have no positive effect on CRST Malone’s CSA scores.

    Contractors will be canceled for citations or violations noted on Roadside Inspections for violations of the following Federal Motor Carrier Safety Regulations (FMCSR).

    a. FMCSR 392.2 SLLS4 - State/Local Laws Speeding 15 or more miles per hour over the speed limit.

    b. FMCSR 392.2 SLLS3 - State/Local Laws Speeding 11-14 miles per hour over the speed limit.

    c. FMCSR 392.2 SLLWZ - State/Local Laws Speeding work/construction zone

    d. FMCSR 392.2R - Reckless Driving

    e. FMCSR 392.80 - Driving a commercial motor vehicle while texting or using the telephone without a hands free device.

    f. Driver in possession of a Radar Detector

    g. FMCSR 392.16 - Failing to use seat belt while operating a CMV

    h. Driver Fitness Violations as indicated below:


    1. Driving a CMV while disqualified - 391.15(a)
    2. Driver disqualified from operating CMV - 391.11(b)(7)

    For the first instance of violations of the following regulations noted in citations or violations noted on roadside inspections, contractors will receive a thorough log audit and a DDC.

    a. FMCSR 383.23 - Operating a CMV without a CDL

    b. FMCSR 391.41- Driver not in Possession of Medical Certificate

    c. FMCSR 383.21- Operating a CMV with more than one driver’s license

    d. FMCSR 392.2C- Failure to Obey Traffic Control Device

    e. FMCSR 392.2-SLLS2 Speeding 6-10 miles per hour over the speed limit.

    f. Unsafe Lane Change

    g. FMCSR 392.2FC Following too close

    h. Any HOS violation other than form and manner

    NOTE: A second violation of these regulations within two years of the first violation will result in cancellation of the contractor’s contract.

    CRST MOBILE SAFETY INSPECTOR- a company mobile safety inspector conducts random inspections at the customers’ facilities, terminal and/or on the roadside. Checking for load securement, vehicle maintenance, and fatigued driving. Drivers with log book issues will be routed to a terminal to conduct a log audit and retraining. Again, unsafe and non-compliant behaviors will be scored and added to contractors CSA scores just as if the points were assessed in a roadside inspection.

    MAXIMUM CSA POINTS ALLOWED PER CONTRACTOR
    Unless otherwise specified in this policy, contractors who accumulate 100 or more time and severity weighted CSA points – in one or more BASICs or have 50 or more points in the Unsafe, or Fatigue Basics or 75 points in the Maintenance Basic– will have their contracts canceled immediately.

    UNSAFE DRIVING VIOLATIONS

    Unsafe violations not resulting in cancellation of lease including those identified through outside reputable monitoring sources will result in EOBR use or cancellation of lease.



    HOURS OF SERVICE VIOLATIONS

    Changing driver behaviors with respect to compliance with the regulations in Hours of Service BASIC is vital to the success of CRST Malone.

    False logs, no record of duty status, record of duty status not up to date, and driver failing to retain previous 7 day logs violations identified by enforcement personnel, CRST Safety Patrol and/or internal log reviews will result in a contractor having a choice between accepting an EOBR or cancellation ; second offense will result in cancellation.

    11, 14, 70 hour rule violations in any 1 year period identified by enforcement personnel, CRST Safety Patrol and/or internal log reviews:
    · < 2 years tenure; contractor choice EOBR or cancellation on 1[SUP]st[/SUP] offense; second offense cancellation
    · >2 years tenure:
    o 1[SUP]st[/SUP] offense can choose EOBR or not
    o Any 2[SUP]nd[/SUP] offense will result in cancellation

    Missing Logs – > 10 verified missing logs in any 6 month period:

    • 1[SUP]st[/SUP] offense = placed on stop / counseled by operations
    • 2[SUP]nd[/SUP] offense = on EOBR or cancellation
      • Missing Logs must be verified that they have not been submitted and not accounted for in RAIR
      • Report to be reviewed by Safety with notification to Operations for communication with contractors
      • Notation to be added to contractor information in system identifying as a first time offender
    Half hour break violations
    Operations will review violations with driver. Repeated offenses may result in EOBR requirement.



    MAINTENANCE VIOLATIONS

    Contractors placed “out of service” with maintenance violations will be required to undergo a thorough log audit and retraining on how to inspect a tractor-trailer. This includes (with the exception of log audits) out of service items identified prior to and during PM services performed as required on CRST/Cedar Capital equipment.

    The three leading causes of maintenance violations are brakes, lights, and tires (B, L, T)

    Brake Violations: 393.40-55

    Light Violations: 393.25 (f), 393.9TS, 393.9T

    Tire Violations: 393.75© - Tire- other tread depth less than 2/32 of inch (4/32 for steers), 393.75(a) - Flat Tire or Fabric Exposed

    Any Contractor who has 20 or more time and severity weighted points , or out of service violation, per inspection for vehicle maintenance is required to undergo at their own expense 3 consecutive monthly DOT Inspections with a CRST approved facility.

    GENERAL VIOLATIONS

    It is not the intent of CRST Malone to hire contractors only to turn around and cancel their contracts. CRST Malone is looking for safe contractors who comply with federal regulations and local laws in the interest of their own safety the safety of other motorists with whom we share the roadways. However, contractors who accumulate CSA points through unsafe driving, ignoring the requirements to maintain and accurate and up-to-date logbook, failure to maintain a CDL in good standing, failure to secure cargo properly and who neglect their equipment adversely affect the operations of other contractors.

    CRST Malone has adopted the following progressive approach to positively influence contractor performance and help ensure CRST Malone becomes a safer and more compliant motor carrier with all the benefits that derives for every contractor.

    Contractors receiving CSA violations not specified above will be subject to the following progressive disciplinary actions.

    Step 1

    A contractor will be placed on Step 1 for the first violation(s) a contractor receives as a result of a traffic stop or roadside inspection .

    Fleet managers will counsel the contractor regarding CRST expectations of contractor compliance with federal regulations and local laws and verbally warn the contractor regarding the consequences of getting further CSA points and violations/warnings (see Steps 2 & 3). A record of this conversation and date will be recorded in the Transportation Performance Inc. (TPI) Driver Review section.

    Step 2

    Contractors will be placed on Step 2 (FINAL WARNING) for the second set of violations they receive as a result of a traffic stop or roadside inspection.

    Fleet managers will counsel the contractor regarding CRST expectations of contractor compliance with federal regulations and local laws and formally warn the contractor in writing regarding the consequences of getting further CSA points and violations/warnings. A record of this conversation and date will be recorded in the TPI Driver Review section. . Contractors will be routed to the nearest terminal for DDC, be retrained in the area(s) in which they have demonstrated less than compliant performance, and a final warning will be issued.

    Step 3

    CRST Malone will cancel the contract of contractors that have accumulated more CSA violations after the 2[SUP]nd[/SUP] and final warning. The only exceptions will be for Non-preventable crashes and maintenance issues that could not have possibly been known to the driver prior to the inspection. This will be determined by the Director of Safety.

    Seems pretty straight forward to me. I have been waiting for Malone to put something in place, like ELogs and what not. Personally I have failed a few times in the "paying attention" dept. I am going to step it up a couple notches and work real hard to get some time distance from my record.

    They are Thai... Last I heard the O/O that Lease ON TO CRST Malone have the choice to have them or use paper.

    Thanks I thought so, been reading a lot about Malone, mercer, prime, jct,...
    what I really like about Malone is finding your own loads.
    With mercer you gotta buy your a truck, and from what I have read even the o/o that have had their own trucks a long time have a hard time with their system at first.
    jct we'll refer need I say more.

    That is the best thing about Malone, the fact that you can pick you own loads, and not just from a company load board,,,anywhere. I have researched JCT in the past and read more positive than negative but, I want to pull a flatbed. I would never suggest Prime,,,a whole lot of negative there.. I hear a lot great things about Mercer but, they don't have L/P Nothing wrong with that though. Heck, they sent 10 drivers to Kevin Rutherfords CMC this year and I was told they will be sending 20 to his CMC next year. That is pretty good thing for a company to do, in my opinion.
