Put yourself in the ops shoes,how would you have liked to go thru all the humiliation he and his co driver went thru.The trailer was reported stolen and it probably was found long before these guys picked up the trailer but my guess is someone at CRST forget to remove it from their system and these poor innocent drivers are the real victims in this mess.Ya sue the heck out of CRST.

That's right,thats going to look real good for future employment.Drivers are always the ones that suffers.

I had to laugh when u said it was an honest mistake,lol.Nothing companies do is honest.Same with the law for that matter.

You wanna get someone's attention really fast? Call a major news service and tell the story. Or post it on Facebook. I bet the company would be apologizing really quickly once word got out.
Of course, going that route will likely cost you your job at some point... even getting a lawyer involved will put you on the short list as first to go the moment you mess up. But, I don't think you'd be losing much in that case - this is clearly the company's fault in some way. Like has been said before, the police had a report that something was stolen and they arrested those who possessed the item. Not their fault. This has "lazy/incompetent company office person" written all over it. -
I know of someone this happened to at LANDSTAR back in the late 90's , was handcuffed and put in the cruiser until things straightened out , trailer had gone missing a few months prior , reported as stolen then suddenly shows up some place and gets back into the system and no one corrected the status with the police from stolen to recovered..

If it was stolen wouldn't there have been a insurance claim, or something in the company computer system throwing up flags that a stolen trailer is dispatched on a load?
The drivers aren't negligent. But isn't the company being presumed guilty. Almost sounds hypocritical.
Still unsure what the lawsuit towards the company would be for, and since you can't prove negligence here, how would you prove it in a court.
I'm not a lawyer, but I did stay at a Holiday Inndouble yellow, CMBreen and Truckinchic Thank this. -
