There's no DOT requirement for a BMI test or a sleep test - call the FMCSA in Washington. That's the clinic/doctor - unfortunately you have a six month card so you're stuck until then.

    Rug_Trucker and volvodriver01 Thank this.

Really? And you BELIEVED this quack??? No disrespect intended! :) Because he took ya... hook, line and sinker. The medical requirements for a driver are set in part 391.41 of the FMCSRs. It says NOTHING about BMI.

    http://www.fmcsa.dot.gov/rules-regulations/administration/fmcsr/fmcsrruletext.aspx?reg=391.41

In order to change this, the FMCSA would have to go through the entire rule making process... something they haven't done. It'd be a couple years to do it, and the drivers and carriers would be howling mad about it.

Now, that being said... a doctor on his own can't change the requirements of a physical. A carrier CAN add additional requirements, subject to the labor laws that say it must be necessary to peform the task that you're being required to do. This has nothing to do with the FMCSRs or the so-called "new regulation" that the quack was pushing on you.

BTW... you'll be better off loosing the weight! :)

Ok I guess we will see because another driver just had his done at a different place and was told the same thing. It must be an Arkansas thing..but I eat to live and dont live to eat so loosing weight is easy for me sincr I an a former US
Service member. Eat less and excersize more..

I know my Doc and she did not agree with the rules. She even said that I was not obeasr. But rules are rules.Let us know how it goes when you get your physical done. Thanks

You didn't by chance ask this gal if she was having trouble making her mortgage payments?

If 70 is the difference from her making her mortgage then she is in trouble. But regs change all the time. Dont be surprised when it happens to you.You can quote regs all day. To the doc but iys what they s.ay and that is why most of them collect the money up front

The regs can be added to but not taken away
But have a good day driver and lets agree to disagree.

The regulations cannot "be added to" without going through a formal process. And we will disagree.
