As some of you know I'm at home with a medical leave of absense. I was disqualified on my last DOT physical the end of last month for my diabetes and sleep apnea problems.
I have paid for critical care, short term and long term disability insurance through my employer. They deduct payments weekly from my paycheck.
I filed a claim with my short term disability carrier. It was denied because my policy lapsed. ??? I finally got an activation code today in the mail to look at my account online.
It shows the last payment was made on 1-12-2010. That's the time our company closed the headquarters in S.Sioux City, NE and moved to E. Dubuque, IL. In other words, they stopped paying my premiums when they moved. But they kept deducting the money.
I have paid in around $3700 since I had these policies and they are about $1200 in default since they stopped paying. The policy has a $1500 a month benefit.

Talk to an attorney. If they were charging you for the insurance and not paying the premium, they should be responsible for the benefit you would be receiving if they had in fact made the premium payments.

If you can prove that it wasn't merely an clerical error but a Company official who did this to pocket your premium;they are going to jail.Ditto on the lawyer,you may soon become a partner in your own very own trucking Co. especially if they did this to more drivers.

They lost most of their payroll dept in the move and hired all newbies but one that stayed. Payroll mistakes have been made, but I don't see how something like this could go unnoticed for 11 months. I'll call the insurance company tomorrow and go from there. Thanks for the replies.

The more I think about it. A company can't hide health insurance payments as everyone uses them. But disability? I'm sure there are very little claims. Injured at work, you get workers comps. It's very possible they are pocketing money with a high turnover rate industry.

Case in point the "former" National Recon hid the fact that they had NOT made a single payment into employees Health plans in over 3 years. They had simply paid the bills themselves. All the employees were young (under 30) except for one healthy older gentleman, who was covered on his wife's policy.
Until one employees 5 year old went into the hospital for major medical problem, costing over $50k for the initial hospital visit, and even more for follow ups with specialist.
Then he got the bill.
The company closed within a month. The owner now lives in Jonesboro, AR. Probably still in the same business. Remanufactoring heads for trucks. He was ranked 2nd behind Cummins, when this happened.
Good guy loses. Bad guy wins..... -
Did the sleep apnea just come up? Did they ask you to take a sleep study test? Same with the diabetes, is this new to you or did you know you had it and failed a test? Just interested since I have SA, but have a machine and all the medical stuff to go along with the situation. I thought that if you had diabetes and it was controlled by diet and excersize it was exceptable.

I'm non compliant with the CPAP and my blood sugar was 278 (One Touch average 172), so doc temporarily shut me down until I can prove otherwise. I'm probably getting a BiPap but I'm shooting for surgery. I been having problems driving, where my vision blurred out for seconds and it wasn't falling asleep. So this is best. My vision has dropped from 20/40 to 20/70 too. I have a follow up next week. I'll know more then. It sucks because income went to zero. I'm taking a draw off my 401K so I'm okay.
I talked with American Fidelity today. The last payment was made Nov 2009.
I emailed one of them online attorneys to feel out the situation. Here's what he said.
The company moved Jan 2010 from NE to IL but they still use both addresses and pay unemployment insurance to NE (been checking all my options). And I just moved back to TN from IL. I paid IL taxes all year. So which state do I seek an attorney?
