But with the company in receivership that would be hard
Maybe insurance will cover it

That is not how civil lawsuits work, she does not have to prove she is right beyond all reasonable doubt all she has prove her is that theory is more likely true than not.

Different burden of proof:
Reasonable Doubt

Preponderance of the Evidence
