Log Violation

Questio to anybody that can help.. im new to truckin so i am unsure if this is a bogus log violation and if it is how can i fight it .. i got my log book checked in new mexico it was about 230 at night i started driving at 930 at night .. and the guy at the scale gave me a log violation because he said when you roll into the next day i am suppose to pull over at midnight and start the new page for the new day.. now as far as i know you only have to log everytime you stop.. help and let me know if im right and if so how do i fight it... who do i contact.. thanx

    You don't have to stop and pull over at midnight if you're driving but if you gave him your logbook without noting the duty status change when you stopped driving he still had you . Are you a company driver ? The company safety department should fight it to keep the violation off their record

    I have used this and it got the ticket thrown out but you do have to go to court to do it...395.13 (b)(3) in the Federal Guideline Rules and Regulations states "A driver failing only to have possession of a record of duty status current on the day of examination and the prior day, but has completed records of duty status up to that time (previous 6 days), will be given the opportunity to make the duty status current.

    fight the ticket... i think that you should be able to get it dismissed... like the other poster said... let your saftey department help you... a word of advice.... when i was driving .... most of my driving time was a night.... if you start out at 9:30 PM go ahead and at least fill out the next days log... all that you have to do is write your name and trk and trl numbers and if you do a recap... fill it out and just leave your current day blank....

    Be careful out there on the big roads....
