Not sure about tickets but if you take your tailgate off you will need some sort of support to hold each side of the bed up. Short term no problem but long term and you Could have some collapsing of the side walls. I have seen guys use anything from bars across to pipe at 45 angles as braces.
I do not know why a cop would pull you over for it unless your junk was falling out the back.

Yup, agree with Tanhands, that tailgate is a structural part of the truck.

I have ran 280k in a 2008 dodge with no gate and the bed sides are fine,I have seen the beds fold in and out but not in 20 years or so. Lol.

The joke is that you get improved mileage by reducing the draft, when test after test proves the tailgate is designed into the truck and you get better mileage with it shut.

The jokes not on me,I simply don't run it because its quicker to fuel my big tank and grab crap out of tool box. The +\~ of the fuel it affects is simply not enough one way or another for me to even think about.

If you have a need to have it off it probably won't matter. If you don't need it off then why take it off? I know that the test say the tailgate diverts the air in a way that it improves MPG. They say that a tonneau cover will help with MPG but the added weight of the cover negates any positive effects.
But for the OP I don't see a problem either way as long as you don't lose anything out the back. I keep stuff back there so my tailgate keeps it from sliding out.
