sleeping in a pick up truck

    Whats this I hear about sleeping in your pick up truck without a dot approved sleeper is legal now, Apparently the law has changed? I cant find anything saying this is true so I was hoping one of y'all could help me out.

    Yes it's true, the rules have changed and you can rest in the truck. I have a Woodhouse sleeper in mine.

    Well thats what I am in the market for getting in my trucks. But people were saying you could sleep in the back seat of your truck.

    They are using a loophole developed when the FMCSA started requiring the 30 minute break, the definition of off-duty time has been amended to include time spent resting in a parked CMV, so if you log off duty instead of sleeper technically sleeping in the back seat, or anywhere else for that matter is now legal.

    The reference is Part 395.2 1 (i), where the FMCSA added an exclusion to the definition of on duty time to exclude all time spent resting in or on a parked cmv, except as prohibited by the haz-mat regulations.

    It is a grey area loophole, but it is legal, at least for now.

    the loop hole is pretty stupid...soon enough long hauld diver sleeper will be 10 inchs wide becuase the drivers can just log off duty.

    where in the regs does it say you have to log sleeper berth?

    It doesn't. You can be awake and in a casino all 10 hours and log off duty and reset your 14.

    I know it doesn't , I haven't logged an hour in the sleeper berth in years, the 30 minute break has nothing to do with it.

    It may be legal, but I'd sure rather sleep in a bed than across the seats. My Volvo with a 61in sleeper is too small most of the time.
