Forced to Run Over Hours of Service

    What can a driver do if they are being forced to run over the hours of service? This company sets up loads leaving from detroit terminating in Lerado TX, the back haul picks up in Dallas and delivers in Detroit. They expect us to drive 800 to 900 miles per day. I refused this load and now i think my job may be in jeopardy! I am an independent contractor so Im not sure exactly what my options are except to find a different job

    Sorry to say, but in this day of CSA2010, well actually, BEFORE that....you should ask yourself this question....

    WHO will it affect the MOST? Your employer, or YOU?

    Your employer will just find someone else to do what you won't...

    YOU, run the risk of having it on YOUR DAC, and chances for employment by another carrier....

    It's YOUR life, and potentially, OTHERS, when forced to run tired/sleepy/ fatigued.

    Ask yourself, is THIS employer WORTH all of that??

    All that said, I can't tell you what you can do, other than find a different company to run for.

    You're pretty much caught between a rock and a hard place. Dispatch says "do the best you can." which I always translated to "get it done, or find somewhere else to work. You are replaceable." Safety says "Never drive past your HOS." DOT is looking to add your money to thier budget. So do you run, and run the associated risks? Or turn down the load, and see how fast dispatch can get rid of a driver without firing him. Me, I turned down loads that couldn't be done legally. After I talked to dispatch about repowering the load onto a driver with more hours, and being turned down. But I generally have a good reputation of taking on JIT, and getting it done. I'm hoping (because I'm an incurable optimist) that CSA will put an end to this crap, but I doubt it. Like they say, safety stops at the dispatcher's door.

    Is this stated on your QC? (if your using one) If so, call safety. If that don't work call the DOT and it'll be their ###. That's just your FM trying to get you to do so. Some companies have a no force policy where if a dispatcher tell's you to run illegal report them. After so many complaint's that dispatcher is history. They do this at FFE I know for sure. I've never had problem's with my normal daytime dispatcher. I do have trouble out of those night time and weekend dispatcher's that want you to do them a "favor." I did once but almost got me in deep #### so I don't anymore. I tell them to kiss my ### if they don't like it and find someone else to do it right after I get their full name, make notation of the time and all so I can have that person reported.

    Nope, No QC. they dont even collect our logs! I have a years worth of my logs (both copies) at my house. THe company has no record of what we do. They just dont care, I guess that is because I am and Independent contractor (10-99)?? but Im not sure.

    their truck but its set up to look like Im leasing it from them even though im not. The more Im thinking about it Im realizing i really need it find a real company.

    Wow!! Looks to me like you are in an extremely LARGE hole, with very little way to get out.

    Whew! I think I would be trying to find me some place else. Never take your log's or anything? #### it man! Let me think this through. DOT come's in to company for logbook audit's. Your name and truck number is on the paper work but no log's. See where this is going? I would with no doubt be trying to find me some place else. If they aren't taking those then so much for what I said about reporting it to the safety dept.
