DUI Troubles

    Got a DUI in 2009, went through the process to have it taken care of and expunged off my record, however, some paperwork never got through. I held a CDL at the time of the offense, but was in my POV at the time. Skip forward to December 2011, I'm pulled over for a minor traffic violation, where they check my records and find that I'm wanted for failure to appear. Evidently, my DUI case was still open. I was convicted and sentenced in December, I now have one year suspended license, all other sentencing has been dropped. Who's the best bet as far as companies go for me to get back out on the road? I know there's generally a time frame of 5 to 7 years for most companies, I have heard 3 years on a few, but is there any hope for any sooner? I haven't touched a drop of alcohol since that night of the arrest in 2009, and other than the DUI charge, hold a clean record. Any help is greatly appreciated, and if this is in the wrong section, I apologize. Staying up all night with my 15 month old daughter and then being up with her all day takes it's toll after about the 36th hour of being awake.

    If you HAVE a suspended license now???

    You ain't going nowhere's for this entire year. I wouldn't be too worried about who will hire you just yet.

    Something don't sound right here? If it was supposed to be expunged there should be a record of it? The lawyer who represented you should have a record of it. I have had all my papers not getting signed years ago by the judge and I had a failure to appear but it was taken care of quickly.
    Sounds like you didn't complete whatever the court setup for you?
    You are screwed for a awhile.

    That sucks but like other said you should be able to clear this if everyting you said is true! I had a similar situation years ago it wasnt a DUI but unpaid toll that ended up suspending my license not once but 3 times which made me habitual offender even tho everything was paid and taken care of. I ended up hiring a lawyer cost me $2000 but i was able to clear everything and seal it. So if what you said its true you shouldnt have problems taking care of it, it might cost you some money but its worth it. System sucks and you have to make sure you keep all of yout paper work for years. Also, if you get this done if i was you i would request them to seal your record so no other companies can find out about this!

    How is there even a process to expunge a DUI less than 3 years old? I could see being able to expunge a DUI that is 20 years old(although not really), but <3 yrs? That isn't right. It's almost like there is no price to pay for committing the offense in the first place.

    What I read on VA expungement is the state only expunges records of dismissal or not guilty. They won't hide convictions in that state.

    It sounds like what you did was a pretrial intervention. Do this, this and that and the charges will be dropped. Don't follow the procedures and it comes back on you.

    Your only hope is to drive for someone that doesn't do background checks or it doesn't bother them. More like a owner operator with a couple trucks or a dump truck driving job. They are out there.

    It's more of whether you are insurable or not. Even your personal vehicle you have to get special insurance like SR-22.

    I would look on Craigslist. Otherwise, it's a waiting game with all the rest.

    Another thing the bigger companies will want is proof of successful completion of a treatment program.

    What a load of crap that this is even an option. DUI is one of the most serious offenses you can commit with a vehicle. The fact that the opportunity exists to "make it disappear" is a slap in the face to anyone who has themselves or had a loved one injured or killed by an under the influence driver. Want to give supervision for going 8mph over? I'm on board, but never, ever for DUI.

    That sounds good till you get the screwing it gives.
    Some states try and enforce CMV rules on you when you are in you
    POV, that means the .04 rule and your legally drunk. Less than half a beer.
    Or lets give you another example you go drinking and decide not to drive and are asleep in your car in a private lot you could still be arrested for DUI.
    Theres not a one size fits all for this here.
    But still the the OP don't sound right to me.
