    Trailer Can Swift find old criminal defered sentences in background check?

    I'm currently attending truck driving school, but not through any company. I'm attending an independent trucking school. I have no DUI's, and a relatively clean driving record (Which shouldn't be a problem).



    I'm starting to think about where I want to apply at, so that I'm conditionally pre-hired before I graduate. I've been informed that I need to be 100% open and honest about EVERYTHING in my past, which I'm fine with, however, I do have two very old defered criminal sentences that I'd much rather not have to bring up.....one from almost exactly 10 years ago, and one from 13 years ago.

    I completed my defered sentences on both charges, without any problems, so both convictions were exponged (Wiped clean from my criminal record). Therefore, any criminal background searches, by law, should not reflect these charges being on my legal, criminal record.

    Nonetheless, I'm looking for a good babysitting, beginner's company to start my career off. I'm leaning pretty heavily toward Swift at this point in time. I've been made aware, though, that these huge companies (Especially Swift) have HUGE departments whose sole purpose is to dig up old, almost forgotten dirt on applying, potential drivers, and from what I hear, they're quite good at what they do. Therefore, even though a legal criminal background search through the court systems should not turn up any results on my old charges, I'm wondering if they have alternative ways of finding out about ancient history?

    These are both charges from when I was pretty much a kid, and they in no way reflect the kind of man, and father that I've grown to become, and to be quite honest, I'd rather not mention the charges if I don't absolutely have to.

    So in recap:
    Does the almighty Swift Company criminal background check Department have the ability to dig up old charges on someone, somehow, even if a check through the court systems will show nothing?

    I would especially value the opinion of veteran Swift drivers, with personal experience in this matter, or drivers who have seen this kind of situation take place, but I still welcome the viewpoints of all experienced drivers. Thank you for your time and opinions. God bless.

    No they can't. All they do when checking that stuff is run a standard background check. You really don't have anything to worry about.

    anyone can "find" it. It's public record. It's an arrest after all. Best place to look is the public weekly "sheriff" roles that are published in the local paper. All those do is list you as being arrested. Not the end disposition regardless of the outcome.

    As to finding the rest of it?

    It's a public court record that was a published schedule. Your name was listed along with the reason for the court date and hearing. Not the end disposition and outcome.

    And to top it all off....

    People have started companies to have crawlers on the web scouring for all this wonderful tidbit of public records and then offer to sell it to any sucker that's willing to pay the fee. Regardless or outcome or final disposition.

    Thank you Bubba. I appreciate your info. Have you ever worked, or do you currently work for Swift? As much as I welcome your advice, if anyone has a different opinion, please still feel free to share it with me, but please just inform me of why you think differently.     I have no clue if they use them or not. You should be aware that the information is there.

    Some of those same companies also are paid to also scour the social network sites like LinkedIn, Facebook, Myspace, twitter and others.

    It's rather interesting what google or bing pulls up too when you search for your own name and location.


    just trying to share with you how easy it is to find information on your own name/background.

    Ok USA truck nor the us army found my felony deferment that was expunged. The arrest or the disposition. The army checked in 1994 so no Internet. But I did get top secret clearance. They were interviewing people before I even
    Left for boot camp because of my MOS and assignment. I was in intelligence.

    Anyways...
    I never put it on anything. I have a concealed carry permit and just transferred it to another state. No issues with either state. Top secret clearance in the army in the 90's. Worked for FedEx on airport property and passed their background check. Have an EMT license in three states and all three did a thorough back ground check as I delt with pharmaceuticals. Passed them no issues. Passport issued with no problems. FDA background check as I worked for a pharmaceutical company no issues.


    I say all that to make my point. Sorry to be so long winded.

    I'm not saying that swift won't find it. Anything can be found if the right rock is turned over. But it's highly unlikely.

    There's always the chance that the background check company hasn't updated their records. Granted, after that long a span of time, it's very unlikely. And you probably don't need to worry about it if the convictions were misdemeanors. The safe thing might be to just declare it up-front, or ask a Swift recruiter what would be the best route to take.

    Swift will tell you to list it "just in case" but most likely won't come up. I wouldn't list it and if Swift does say something, state they were deferred and expunged, therefore your criminal record is non-existent. Also, I'm sure the Army did find it, but due to classification notice of it being deferred, it was marked as a no concern. Top secret would have only been denied for murder, treason, terrorism, sale and transfer od narcotics, but only if convicted. Your case, you have a arrest record, but no conviction record. There is a difference between the two.

    Swift found my 1976 arrest for DUI !!!

    No conviction, just arrest !!!
