That is exactly correct, all the time he was at the scale had to be "on duty not driving" when his 14 out ran he was still legal as long as he doesn't go back to the driving line til he has his 10 consecutive off.

The more open you are with them the more human they will behave. Most of them are just doing their job. However, they are trained to spot certain behaviors as cops, such as avoiding eye contact, elusive or vague answers to questions, or just nervousness, and that triggers all kinds of problems.
So I always act like I've got nothing to hide and usually engage them in conversation immediately.
When they see that I'm relaxed and open, they become relaxed and open.
    Works like a charm.

Only thing is once he was considered to be "out of service" that officer or any other officer did NOT have the authority to tell him to move that vehicle..even if there was no parking area. Those laws are written by the feds not Texas DOT. I don't have a dog in this fight nor was I there...But if I had been in his shoes I would have refused to move the vehicle, if the state wanted it moved then call a wrecker. Then I would have called my safety man and let the company handle it from there...As a driver YOU are responsible, if he moved that truck knowing he was in violation and had an accident then THE DRIVER is in REAL trouble. This is an example for a driver to let those laws protect HIM.....

I pulled into the bottom of Maine last year, cash box was open, he asked for my book I gave it to him. He asked where I was going I told him the border. Nice and polite, yes sir no sir, When he looked at my book and realized I had just enough time to make it he smiled, ordered me over for a level one, took 2.5 hrs found nothing. screwed me for hours. I had just enough time to make Bangor, and being day 6 had to sit and wait for hours to roll over.. Not cool. A€€hole move of the year as far as I can see. Some troopers are just like that. Hopefully karma will rear its ugly head one day and insert something large where he doesn't want it.

so what your saying that is if your out of hours and your OS'd and the Officer tells you to move your vehicle, If you wreck or tear something up it wont be your fault for being tired?
as one put on here , notify your saftey dept and let them know you have been OS'd and are out of hours and get their OK to move, but If you get in a wreck still its YOUR fault.

There isn't more to this story as you and many others think. I will upload his copy of log page from that day as soon as i get it and it will explain itself. Why is it that so many of you are assuming that officer was right when you, me and many others have come across similar types before. (thank God there isn't too many of them, but almost every police dept has power abusing black sheep) :biggrin_25513:

Some of us have been out here awhile, and we know a trucker story when we hear one. They normally begin with you are not going to believe this.......... Or Something to do with black helicopters coming out of nowhere because some scale master was going to take off the seal. Cops are human they make mistakes but the story is just not adding up.
