    Can a driver that returns home daily for his ten hour break still claim a per diem expense

    You can "Claim" almost any deduction you want on your taxes..
    Getting a audit and a inability to to prove deductions can be co$tly fines and even jailtime.

    But the answer to your question would be ...Legally?.. No..

    Per Diem is a tax incentive offered by the federal govt to truck drivers who are on the road, away from home. For OTR drivers, per Diem can only be claimed on the days (nights) spent sleeping in the truck or motel, away from home. If you were to get audited, the IRS would require log books as proof of being away from home.
