Moving Violations and you.

Very quick and simple question for you folks.

How long will moving violations (speeding) affect your ability to get commercial driving jobs? If I'm not mistaken, it's 3 years, correct? I'm not sure if that's just how the industry works, if they fall off after that amount of time or if that's just how far back these companies care? I know there's a 3 year MVR and I THINK that's what most of them go by, correct me if I'm wrong.

My record is pretty spotless aside from two moving violations, both of which occurred about two and a half years ago. I've never sped since, and never would ago (I'd rather get run over) and both were in my own personal car, but they've kept me from getting a local driving job where I am. Anyways, that's a whole other story.

I've been told by several places that once these moving violations fall off at the 3 year mark they would be able to hire me so I'm just looking for some further insight and explanation. Thanks!

The Law is for a CDL class A is five years on your recorded both private and CMV. I hope that helps you? But yes they fall off after five years

    Thanks for the reply.

I've been told that nothing ever "really" falls off your record and that with extensive background research places can find tickets dating back as many years as they want, but I do know the two standard MVR reports are a 3 year and a 5 year. I just see a LOT of companies saying X_Amount of Violations within 3 years and have been told that "After those being 3 years or older we could hire you."

Depends on the insurance companies. Many are 3 years but you find companies that will ask for 5 years

Right, exactly. I know a lot will look at the 5 year, I'm just confirming that as you said many are mainly concerned about that 3 year. After that they don't care, as far as moving violations go anyways (which is all I have).

Depends on violations too. Like reckless driving, or 15 mph over is much more serious than a stop sign. What are your violations?

1 is just a simple speeding ticket. 1 is 15 over (was in own car, middle of no where highway, etc. yes I was dumb and was going literally 15 mph over) I've been told that even though it's a 15 over it wasn't considered reckless and that after 3 years it wouldn't be an issue for most companies who look at 3 years. I was told this by a couple of big LTL companies. I've basically been told that even though 15mph + is more serious than a normal speeding ticket and a big dis qualifier, that the companies disregard it after the same amount of time as a speeding ticket, because that's what it was, unless there was reckless driving involved (which in my case there wasn't).

when you apply at companies they'll tell you what they want for insurance purposes. it's generally 3 years. unless it's a dui. then anything goes. could be 5 years, but usually 10 years.

in utah, i can pull my lifetime mvr and see every ticket i've ever had.

just 1 speeding violation should keep you from getting hired, but if you got more, that just shows a pattern, 2 at 2 1/2 years apart, and the companies you talked to won't hire you? I think that kind of crap, if it was 2 in 2 1/2 months, that would be a different story

Fight every ticket for moving violation! Hire attorney. The judge will always give you some kind of deal. Maybe you pay the ticket in full but no points, no record. I had speeding tickets with my car, that were turned to parking violations, paid the fine in full.

I personally think that, to be fair the MVR for CDL must be separated from the MVR of normal DL, so when you apply for a job - you present only your commercial MVR. When you drive a truck, you always take it more seriously.:biggrin_255:
