I recently had a non preventable (on my part) accident with a driver of a pick up truck. For purposes of settling an insurance claim, I need to try to establish a fair economic value for having this accident listed on my otherwise spotless cdl driving record of over 9 years. I understand the process for determining equipment damage and personal injury. But how do I go about determining an economic value for possible loss of future earnings due to this accident now listed on my record. In essence, my reputation as a safe driver has been damaged by the at fault driver. I still have my job but my employment opportunities are now severely limited until this accident falls off my record. That is the cut throat nature of the trucking industry. In a fair world you're either a safe driver or you're not. But our reality is, you're either lucky or you're not, to hell with who caused the accident. So I need to find out if anyone else has established a value in the past? What did you and the adjuster settle on? To all others what would you reasonably demand for a non preventable listed on your record?
What is the economic loss for having a non preventable accident put on your record?

Good luck trying to prove this one. If you are successful, I've got a list of frivolous lawsuits I could use your help with.

There's nothing frivolous about having a non preventable accident on your cdl. Just ask someone who has been denied a job because of it. Your driving record is THE key to employment. And if someone else causes a non preventable to be listed then they have compromised your employment opportunites.

im not seeing where you lost any value or potential earnings over a non-preventable. I only know of one company to my knowledge that even considers a non-preventable for hiring and that's OD which not many will qualify for hire anyway.
Sure a preventable will damage your value as a driver but a non-preventable? Good luck with the frivolous money grab.Shaggy and Cranky Yankee Thank this. -
How about the pain and suffering you must be going through as well? Maybe those nightmares from the non-preventable will qualify you for disability?
Bunch of horse crap if you wanna know....some slime ball lawyer has your head all tied up. Good grief what is happening to this country!?Puppage, G.Anthony and flyingmusician Thank this. -
You didn't lose your job over it, so how is there an economic value?
I guess you could say that you were applying for the top paying jobs and now you can't get them. The difference in top pay versus what you are getting now would be the value.
Although, if it is a non-preventable on your record it should not hamper your chances of being hired someplace else. -

2 deer strikes
hit once in a truckstop major damage
hit once in a rest area minor damage
stepped right into one of the better private fleet jobs out here with a very picky company when it comes to hiring qualifications. never was an issue for them. non-preventable=non-issue at all but the very pickiest of the eliteLast edited by a moderator: May 9, 2015

Please explain that.
Now on to the frivolity of your so-called lawsuit, like someone else said, good luck with that.
You STILL HAVE your job!!!
Call me when the court date is coming, I wanna be there and laugh along with the other sides lawyer and maybe perhaps the judge.
I hope the judge admonishes you for trying to get a frivolous lawsuit in his court room.
You LOST nothing, but gained a gigantic egotistical head, watch out it doesn't explode. -
News Flash! Your career wasn't hurt.
What company denied you a job because of the non-preventable?
