Ticket for 5 ton truck road

    Well, today I got stopped and ticketted for going down a " no cmv over 5 tons allowed" road. Obviously a bad idea but the cop never weighed the truck so how can he say for sure it's over 5 tons. Anyone ever deal with something like this . I'm thinking I could get it beat in court since they don't have the exact weight but I'm not sure.

    Well unless your bobtailin a single axle daycab there ain't any class 8combo under 10k...but feel free to go fight it....im gettin judge jus gonna ask to see registration for trk/trl and since mt reg weight gonna be I've 10k on either....

    I was driving the dump truck in my avi without a trailer and empty. I think the empty weight is like 27k but how can they enforce it without having proof of being over 10k. All the registration will say is the gvw and I won't have that with me in court and even if I did the gvw isn't empty weight.

    I love your defense theory, if I was the judge, I'd give you a not guilty.
    i know Missouri has signs that say " No trucks licensed over ? Tons in the left lane"

    Don't insult the cop's or the judge's intelligence. You got busted. Not sure but I suspect you may be a "local" and knew better, but I apologize if I'm wrong on that count

    but i got to ask what were you thinking. not saying i never run over weight or run over loaded on weight restricted roads. but anything restricted to the point a empty rig can not drive on it i stay off that road, just asking for it if you do

    Ever try to register a cmv w/out a weight ticket? Its there....im posting this w/my phone on top of my IRP cab card....2boxes right next to each other

    in my cases #1 marked 18.5k

    I believe they go by your registration GVW. So even if you are driving empty and your GVW is 80,000 you cannot go over anything lower than a 40 ton bridge. Also you stated no CMV which obviously would apply to you.

    In MN a 5t road is axle weight not total truck weight. So an empty truck or dump would be very close if not legal.
