Yes if you drive strictly intrastate in Ca you are allowed to drive 12 and have 8 off, if I am remembering correctly. My brother is getting a CDL down there and when this came up I looked it up (sorry dont have the website). Maybe the law is from days past that they somehow forgot to take off the books but I dont think so. Like you say LogsRus federal law "should" superseed the state law but if that was the case then why would that law be on the books anyway...

See the comment right above mine? It's for within California, not OTR drivers. All states can have different regulations if intrastate, however interstate drivers must follow DOT regulations :biggrin_2551:

It's funny how it is explained that this is how drivers cheat the system in order to make more money, here is my deal and I ma sure it is this way for most others also. If I was to cheat it would be because I have to, in order to make enough money to make it worth it, to be away from home, to live in a tin can for days at a time, and to bust my ### pulling a flat, Now no one is pulling my arm to do this job, but in my case it is what and all i know, I have done it all my life, I am allmost 40 years old and have a family to support, I am not and can not go back to school to be a doctor or lawyer, I do not have time, I have a mortage and bills just like everyone els, Now! there was a time when I could drive normal hours and make a decent wage, I am not money hungry, I want too be comfortable and will not have it any other way for my chirldren or my wife, that is my responsibility, in order to acheive that I have to run a certain way, to make the money I need ,,, I repeat the money I need not want, as I have said in another post, I would love to take 10 hours off every dang day sleep for 8 hours and have the other 2 for meals and a hot tub, but the fact is I need to run, to make it, and all the safety guys with their kakis and 70k a year jobs looking at my logs, will just have to understand that I need to survive and will do so the way I know how, it use to be alot eaiser than now, I used to make more for just having the licence I have and the skill I have, but now I have to be a magician too and put on a great show for all the good little boys and girls who crunch my numbers to make sure I am not cheating their neat system they are so proud of. None of it makes sence with any of the HOS in the current industrie, and no one can dissagree with that, if it did, it wouldnt be such a hot topic all the time, I can say this much I aint cheatin because there is a new mercedes in my driveway and I have to heat my 8 bedroom McMansion, that just aint the case,, And i am not #####in either, I love the job, and love to drive, heck if I had it my way I would drive 16 sleep 4 and look at the stars for the other, and yes still be safe, I know my limits and when I have to close em. But like a good boy I follow the rules and behave myself, like I said above," If I was to cheat".

You take chances just by driving a truck to begin with. Truckdriving is a dangerous job at times, with 940 truckdriver deaths in 2006.

prepass/ezpass can suck... but that's why the thing is velcro'd to the window... quick removal.

fueling timestamps can be planned around, meaning don't fuel unless its conveniant.

a signed "off duty authorization" from your company can help preserve hours of service for those little inconveniances, like 2 1/2 hour flat repairs. won't generally help you "that" day... but at the end of the week it might get you home or to your next dock before your reset.
