The company after you show the qual comm. Take pictures of it, before they delete them.

Also, the next scale house is the Wyoming Port of Entry. Unless called in, your prepass will take you by it.

I also have the bill from the T/A that clearly states that company was advised to buy a new tire and that the company declined to do so!
I planned on stop at the port of entry no matter what Prepass says!
I wish I could hear from dieselbear or MikeMD or some other LEO how they would handle this scenario!

Have you contacted safety?

By law, you should not move the vehicle. 396.7

§396.7 Unsafe operations forbidden.
(a) General—A motor vehicle shall not be operated in such a condition as to likely cause an accident or a breakdown of the vehicle.
(b) Exemption—Any motor vehicle discovered to be in an unsafe condition while being operated on the highway may be continued in operation only to the nearest place where repairs can safely be effected. Such operation shall be conducted only if it is less hazardous to the public than to permit the vehicle to remain on the highway.

i had a similar situation a month and a half ago. it was in arizona, though. knight refused to have a couple of tires repaired, insisted that i drive to the yard, and get them fixed there. well, i spot a dps officer taking a short break, and went up to him to lay it all down. he put the truck OOS real quick, he called knight, spoke to whoever i was speaking with, and FINED that mofo! needless to say, this company was PO'ed at me. i didn't care.

with wyoming though, i'm not sure how they'll handle it. get that truck put out of service anyway, dave. force knight to do something about it.
have you noticed that the DOT has had a massive hard-on for this company as of late?

Have I noticed??? That's why there are cramming the logbook down our throat!
I just have this unnatural aversion towards Law Enforcement! It seems like to me they have a problem with all truckers and anytime they get a chance to screw one over they will. Bear in mind, that is MY perception. It may or may not be accurate! But they scare me stupid!

a week before i had my last most recent stint off, i got pulled into the northbound rainbow, ca scale for an inspection. i was running way "hot" that night. i was kinda sweating it, hoping the inspector wouldn't ask for my logbook. i recognized the inspector. he used to drive for this company. he quit a couple of years ago while i was still somewhat new at swift. we caught up on things, he told me about stuff with knight (lol!), and all he did was a level 3 mechanical inspection. it's been mechanical inspections that i've had to deal with. anyways, the tractor and trailer made it through without a violation, and the previous truck received that lovely "9" sticker on the lower right corner of the windshield.

i have an uncanny ability to receive warnings from law enforcement. i dunno why. maybe it's because of my youthful looks, or maybe because i'm that cool, and they recognize a pro when they see one.

Clean shaven, decent haircut and dress code, clean(ish) truck, and a good personality help alot with LEO's too. I run legalish with a bit of magic pencil manipulation to get maximum miles out of hours worked. This includes occassionally logging a break somewhere I get bogged down.

I understand that, Dave...I have reason to. But if you go in there clean and professional-looking and explain that your company is a bunch of bottom-feeding scumbags who care more about money than safety(which the DOT already knows, from the looks of things), and tell 'em that you're just trying to force them to do what they already should be doing...I think you'll do just fine.

Thanks for the good advice! That is exactly what I am going to do I think. Now I wonder how hard the company is going to spank me for ratting them out to the DOT???
Oh well, if they just fixed it right to begin with...!

Document the heck out of everything. If you can prove that you were disciplined for refusing to drive an unsafe vehicle, an attorney may fix it so you never have to work again.
