What makes it illegal? Did you not read the part about him being part owner. Owners don't have to pay themselves salary. Its called a shareholder distribution.
I have a unique situation and would like to run it by some flatbed brothers.

yea, I agree with most of the others. sounds like a fishy deal/scam? You are going to be a O-O without a truck? ..or be a company driver without the benifits of dispatch..O-R support...? I wouldnt consider anything less than 70+% of the load pay... and still I would prob say adios and pass goodluck

I am a company driver that is paid hourly to drive delivering our material out of Houston. Where I make my extra money is in the back hauls. I am paid hourly while doing the return but get a percentage of revenue. Sounds very similar to the situation I am in. I am the only driver in the company that is doing this because of experience. I have to find the loads, push the paperwork for billing etc.
It sounds like the devil in the details is what they expect you to work for and what you want to make. -
It's gonna be a no go drivers. I don't like what I'm seeing with these so called partners already. I'm out! Gonna pursue other options. Thanks for all the advice drivers. I'm off to look for a good western regional flatbed gig.
