Injured at JB Hunt , Currently being denied benefits.

OOIDA is awesome, the only place I know of that has a real person answer the phone, not a stupid computer system with a thousand menus.

anyone can join, just say you are thinking of being an OO, either way they will help.

sounds like the way he got the injury looks fraudulent, thats why he was denied. injury while turning a landing gear crank? wow you would have to go really fast for that to happen.

to bad he didnt get the trailer into a third party shop asap to have a mechanic back up his story

A guy we know was hurt he is supposedly getting WC but JB Hunt told him they had to let him go which is illegal. He got a lawyer. I told him to contact OOIDA. They get enough complaints like this they may file a class action suit on behalf of all you guys.

hello, thought i was alone in here... :)

Yes he was given WC thru JB, but it only lasted for a week. they turned around and denied him the WC and teminated him. He has an ERISA lawyer right now and JB went ahead and reopened the case, everything seems to be running smoothly, but JB always waits til the last minute to respond, pushing that deadline.

If JB is smart enough, this will not lead to court because it will indeed lead to a big civil case and many drivers will start coming out of the woodworks for past injuries. Seems like they want to keep it in Arbitration Process.

And yes, he should of took it straight into the mechanic shop to have the trailer looked at and see why it jammed but it was like 6:15 at night and the shop was closed. He followed JB's orders to go to the nearest doctor to get treatment right away or he was to get terminated. (they threatened him)

The lawyer says that he has to prove negligence on JB's part to get 100% benefits out of this. Otherwise he does have a #### good wrongful termination case built-up.

Well, ya'll take it easy out there in the world and #### this Texas weather is so unpredictable.

i forgot

lawyer says to find mechanics that work on trailers so we can find out some information on what all is to be inspected on them per DOT Regulations and OSHA.....anyone know or has worked on them?

or if you know someone send them my way please

Seems to me even if they did not prove negligance on J.B.'s part 100%, he would still be able to get workers comp because it happened on the job, weather it was his fault or theirs.

hmmmmm

well like i said before, JB has no WC, they are strickly self insured under ERISA, Texas is an at will state, so i guess he is ###### on that part. other than that we either have to prove negligence or wrongful termination. whichever way, we have both, so we'll just be like sitting ducks and wait to see what happenes.

An orthopaedic surgeon has nothing to do with teeth. They fix knees, hips, ankles, shoulders, etc. bone doctors. I can't believe some of the stuff I read here. Maybe he meant Department of Teeth - not Transportation Rules

ERISA - Employee Retirement Income Security Act is 401K's it doesn't have anything to do with Worker's Comp or insurance.
