This physician is going by recommended guidelines . Here's some interesting reading on that . http://www.fmcsa.dot.gov/rules-regulations/TOPICS/mep/report/Sleep-MEP-Panel-Recommendations-508.pdf
But again this is where the large numbers of wannabes rushing to CDL mills are cutting each other's throats . With 10 times the applicants they need carriers can be more selective . Using a BMI to eliminate applicants doesn't cause a shortage at all .

A young guy I know called me tonight, he was basically fired from a job because he had a 120 air mile restriction on his CDL due to him suffering sleep apnea and was bullied out of a part time bull rack job because of the same. I had heard it before, but I didn't really believe it. I still don't understand it.
I'm glad the machines work for those that have to use them, I know a guy whose machine went down, and the company relayed a spare to him so he could get home. He literally can't sleep without a C-pap. -

Where is OOIDA on this issue ?Click to expand... -
RickG said: ↑No one is denying there is a need for testing of some individuals and many benefit from it . The issue is many that are forced to participate in studies bear an unnecessary expense because they don't have sleep apnea and don't have fatigue problems . There should be a law requiring recommending physicians to bear the cost of testing that shows no indication of sleep apnea as well as requiring reimbursement for drivers

FMCSA is moving forward with this. Their medical review board is already meeting and developing requirements and criteria.
Of course, everything is up to challenges from groups like OOIDA.
Just saying, some of these trucking companys seem to be getting ahead of this issue before FMCSA issues guidelines.
The other guy was right... Any company can set a minimum physical health requirement for hire... they have to apply it evenly among all applicants and it cant be below DOT minimums.
My company had four criteria for a sleep study to be conducted.
BMI, neck size, questionare, and throat/tonsile characteristics
BMI and neck size are two facts that are not subjective
Throat/Tonsile characteristics are examined by the doctor and then compared to chart of varying levels of throat constriction. (can be subjective)
Questionare... any moron can lie and pass this test. Do you feel sleepy, do you have morning headaches, etc... This is where the skinny guys with a sleep disorder slip through the cracks if they lie.
Not everyone that gets issued a sleep test has a sleep disorder. $150 dollars and they are never bothered again, which is way cheaper than some of the other test facilities I have heard about.jlkklj777 Thanks this.
