Man arrested for DUI in wheelchair

Shouldnt he be dead !!!!!

Police say it happened Sept. 23 when 59-year-old Robert Gibson was stopped by police at the local high school.

The high school's School Resource Officer allegedly spotted an almost empty bottle of vodka on the floor of Gibson's scooter.

According to police, Gibson had slurred speech, bloodshot eyes and had slobbered all over his shirt.

Police say he also admitted to drinking alcohol.

Gibson was taken to the local hospital where he allegedly had a blood alcohol level of .405.

Ok, this DUI crap is getting out of hand. If it doesn't require a drivers license to drive it, then it shouldn't be a DUI.

But if you are walking and pass out from drinking, or even walking drunk you are then subject to public intoxication laws.

If he drives his wheelchair into an intersection, being under the influence is important.

Many, Many moons ago i was with a local Deputy Sheriff who
made R.U.I arrest.. Our town had its yearly shin-dig and found a guy RIDING a DONKEY with a bottle of Jack Daniels in his hand.
Only the guy was drunk and went to jail. His wife came and got the donkey...said she got the best deal that night....

R.U.I = Riding under the influence...

DUI goes on your license. Public intoxication or Drunk in public does not. I don't condone the DUI for wheelchairs, horses, bicycles or the like. It just isn't right. DUI means Driving Under the Influence. Key word driving, not steering, which is what you do with a bicycle, wheelchair, a horse or even a skateboard. There is a difference.

If so, then the vehicle, bicycle, wheelchair or horse are subject to the vehicle laws.

Have you not heard that bikes must follow the rules of the road?

Yes, I have, but why issue a DUI for something that doesn't require a license? It makes no sense. I've seen guys intentionally ride their bike to the bar and get issued a DUI. Now, whats more responsible, riding a bicycle or driving his 2000lb vehicle? I just don't think that it should effect their license if they weren't operating a motor vehicle.

I explained the rules. It does not mean that I agree.

However, consider the following.

The bike rider has been drinking. He is riding the bike home and is wandering all over the road. Your husband comes around the curve and suddenly, the drunk bike rider rides across in front of him. Your husband swerves to miss him and wrecks the truck. Now, what do you think at that point.

Later, you find out, this has been going on for months and the police have done nothing because after all, it is a bike, what can he hurt.

Now, you have a wrecked truck. The drunk had no insurance. Your insurance may be fighting you for the repairs.

It is a reason that they must do this. Otherwise who would be at fault?

I understand your point as well, but if they issue a Drunk in public, or something of the like, and he gets repeat offenses on that, then he spends time in jail.

I just don't agree with the whole "on your license loosing points" and the insurance will eat you alive thing. Its a racket as far as I'm concerned.

He's not gonna get in a head on colllision with a car and kill a family with his wheelchair. He should have just got a public intox and not a DUI. It should fall under the same rules as someone walking down the side of the road drunk. A drunk could walk out in front of your car and cause you to get in an accident as well. so, should we issue a DUI for anyone walking down the side of the road drunk as well?
