24 hr reset

    Any driver that delivers to a well site can use the 24 hour reset as long as he hasn't hauled a general freight load or a terminal to terminal transfer in the last 7 days. My guys run cement and frac sand and take a 24 hour reset all the time.

    I'm gonna go ahead and ask for a source on this. I've read the HOS rules and nowhere in the oilfield exemption does it say that.

    Furthermore, in the update on 7/1/13, no where does it say that anywhere. Instead it's across the board, one reset per cycle.

    No it's not across the board they did not change anything in the oilfield exemption except that wait time could now be logged as off duty. The 24 hour reset stays exactly as it was and is in no way affected by the change to one a week. I've been to 3 different classes put on by the DOT to understand the changes and have asked this same question to numerous DOT officials putting on these meetings and they could find nothing in the rules that stated any different. The reason they stated is that in the wording of the rule it is specific to 34 hour resets and not to any resets in the rule. The oilfield has had a 24 hour reset rule for years before they even thought of adding a 34 hour reset to the rules for everybody else.

    I guess I'm going to have to find a pre 7/1/13 HOS rule book. Sounds like your reasoning is legitimate though.

    Here's the exemption:

    Hours of service of drivers

    Code of Federal Regulations

    § 395.1Scope of rules in this part.

    (d) Oilfield operations. (1) In the instance of drivers of commercial motor vehicles used exclusively in the transportation of oilfield equipment, including the stringing and picking up of pipe used in pipelines, and servicing of the field operations of the natural gas and oil industry, any period of 8 consecutive days may end with the beginning of any off-duty period of 24 or more successive hours.

    Notice they did not change the ruling to include the 168 hour restriction. It's all in the wording.

    What happened to this http://www.gpo.gov/fdsys/pkg/FR-2012-06-05/html/2012-13584.htm? This was the Federal Register that specifically said that Water and Sand Trucks don't count? It seems to me there is a catch 22 to this whole thing; it allows for enforcement for NY which started this; and for others to look the other way. Though it changed a lot of business practice I noticed.

    I know there are yards that switched to using 3rd party to load bins with cement; and bring them out due to this letter I posted. Now I know what that 395.1 says but they attached that Federal Register to exclude water hauling trucks and sand.

    If you will read that entire link you posted it does state that the 24 hr reset does apply to water and sand trucks but the wait time provision doesn't. It is also worded exactly how the oilfield exemption is written in the fmcsa book today.

    Scroll down own to question six at the bottom of that link and it says that trucks hauling supplies are included in the 24 hr reset.
