Currently I'm working in corpus Christi Tx. Been with the company for over 4 years and life's been great. However, after a recent meeting; the company informed pretty much the whole fleet that all truck drivers would have to be staying in three rivers tx. They gave us an option of using our own vehicles to drive and we would get mileage pay, stay for the whole week up there but not get per Diem. The mileage pay doesn't include drive time around town for groceries or what not. Or we could shuttle up to three rivers in a company vehicle, have no transportation while there and get per Diem. Does this sound right? Do we qualify for per Diem? How much per day? Should we also get mileage pay if using our own vehicles??? what should we do?

How could anyone who doesn't work for your company tell you if you qualify for per diem or mileage pay with them?

Per diem, companies can pay it or not, their choice. There is no law requiring companies to pay you per diem.
IRS rules on per diem, you are eligible to claim per diem deduction on your taxes for every night you are required to spend away from home. Away from home is another zip code. Now if the company pays you per diem, then you must report that money, and it will reduce your deduction, but the money the company pays you as per diem is free from payroll taxes.
Will need documentation showing you spent those nights away from home, log book... hotel receipts,
And those guys from houston being paid $500 a week, that is way above what the IRS allows for per diem, and the excess will be classified as income.Last edited: Sep 10, 2014
