I agree.........to the extent that Al Qaeda and the Taliban AREN'T covered under the Geneva Conventions, for a couple GOOD reasons.
  1. The Taliban and Al Qaeda are UNLAWFUL Combatants; they wear the uniform of NO Country, they hide among the civilian population and they fire upon Coalition Troops from RESTRICTED Areas, like Mosques, schools and hospitals.
  2. They NEVER signed the Geneva Convention. They DON'T abide by the Geneva Convention in THEIR treatment of foreign troops and non-combatants.
  3. WE SHOULD NEVER allow OUR Sovereignty to be USURPED by a Foreign Country OR the UN.

We cannot invade other countrys imprison the ones fighting us in such countrys and then not follow the geneva convention.
Whether their in uniform or not.
I know i feel the same way why not due it.
Very simply
Our nation is one that sends the message of freedom, democracy, civil libertys not one of torture and no due process.
Im thinking their has got to be a few people their being tortured whom shouldnt be their at all will never know.
People often say stuff thats not true under lengthy interogations and torture just to get it to stop.
We over took there land long ago why are they still there.

From Wiki, which gives the most comprehensive definition of The Taliban:

The Taliban was NEVER recognized by the UN as a Diplomatic Entity. They were a GROUP run by a bunch of religious zealots. When they fought the Coalition troops, they didn't wear any uniform as required by the Third Geneva Convention ratified in 1949:
Quote:
  • Article 2 specifies when the parties are bound by GCIII
    • That any armed conflict between two or more "High Contracting Parties" is covered by GCIII;
    • That it applies to occupations of a "High Contracting Party";
    • That the relationship between the "High Contracting Parties" and a non-signatory, the party will remain bound until the non-signatory no longer acts under the strictures of the convention. "...Although one of the Powers in conflict may not be a party to the present Convention, the Powers who are parties thereto shall remain bound by it in their mutual relations. They shall furthermore be bound by the Convention in relation to the said Power, if the latter accepts and applies the provisions thereof."
  • Article 3 describes minimal protections which must be adhered to by all individuals within a signatory's territory during an armed conflict not of an international character (regardless of citizenship or lack thereof): Noncombatants, combatants who have laid down their arms, and combatants who are hors de combat (out of the fight) due to wounds, detention, or any other cause shall in all circumstances be treated humanely, including prohibition of outrages upon personal dignity, in particular humiliating and degrading treatment. The passing of sentences must also be pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples. Article 3's protections exist even if one is not classified as a prisoner of war. Article 3 also states that parties to the internal conflict should endeavour to bring into force, by means of special agreements, all or part of the other provisions of GCIII.
Article 4 defines prisoners of war to include:
  • 4.1.1 Members of the armed forces of a Party to the conflict and members of militias of such armed forces
  • 4.1.2 Members of other [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. and members of other [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. , including those of organized resistance movements, provided that they fulfill all of the following conditions:
    • that of being commanded by a person responsible for his subordinates;
    • that of having a fixed distinctive sign recognizable at a distance (there are limited exceptions to this among countries who observe the 1977 [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. );
    • that of carrying arms openly;
    • that of conducting their operations in accordance with the laws and customs of war.
  • 4.1.3 Members of regular armed forces who profess allegiance to a government or an authority not recognized by the [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. .
  • 4.1.4 Civilians who have non-combat support roles with the military and who carry a valid identity card issued by the military they support.
  • 4.1.5 Merchant marine and the crews of civil aircraft of the Parties to the conflict, who do not benefit by more favourable treatment under any other provisions of international law.
  • 4.1.6 Inhabitants of a [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link. , who on the approach of the enemy spontaneously take up arms to resist the invading forces, without having had time to form themselves into regular armed units, provided they carry arms openly and respect the laws and customs of war.
  • 4.3 makes explicit that Article 33 takes precedence for the treatment of medical personnel of the enemy and chaplains of the enemy.
The Taliban NEVER complied with THESE requirements necessary to be recognized as LAWFUL ENEMY COMBATANTS.

They NEVER
  1. carried weapons out in the open, they OFTEN hid them under their clothes
  2. wore an uniform or insignia identifying them as enemy combatants
  3. respected the laws and customs of war...they OFTEN hid weapon caches in Mosques, schools and hospitals and used these "protected" places from which to launch their attacks. Also, their treatment of prisoners (enemy combatants OR civilian) didn't comply with the Geneva Conventions as well. One only has to remember the videos of Daniel Pearl, Eugene Armstrong, Nick Berg and dozens of other American, Brits, Turks, Japanese civilian citizens. One only has to think of the tens-of-thousands of Iraq civilians who have been brutally murdered by these Islamic terrorists. [LINK POSTED BY MEMBER] Only Members Can View This Truck Forum Link.
IN ADDITION: Article 2 of the Third Geneva Convention CLEARLY STATES that as a signatory we are BOUND to abide by these Conventions until the non-signatory no longer acts under the strictures of this Convention.

What that means is....WE aren't bound by the Geneva Convention if THEY don't abide by it.

The "prisoners" in Gitmo are treated far better than prisoners in other countries and many times they DON'T WANT TO LEAVE.
Quote:
An inmate of Guantanamo Bay who spends 22 hours each day in an isolation cell is fighting for the right to stay in the notorious internment camp.
Ahmed Belbacha fears that he will be tortured or killed if the United States goes ahead with plans to return him to his native Algeria.
The Times has learnt that Mr Belbacha, who lived in Britain for three years, has filed an emergency motion at the US Court of Appeals in Washington DC asking for his transfer out of Guantanamo to be halted. He was cleared for release from Camp Delta in February and his lawyers believe that his return to Algerian custody is imminent.
Mr Belbacha says that if he returns to Algeria, he faces the threat of torture by security services and murder by Islamist terrorists.
Zachary Katznelson, senior counsel with the human rights lawyers Reprieve and Mr Belbacha’s lawyer, has asked the US courts to block any transfer. “Ahmed is being held in camp six, the harshest part of Guantanamo,” he said. “His cell is all steel, there are no windows, he is not allowed to communicate with other prisoners and he gets just two hours exercise each day in a metal cage.
“He says his cell in Guantanamo is like a grave and that although it sounds crazy he would rather stay in those conditions than go back to Algeria. The fact is that he is really, really scared about what might happen to him in Algeria.”

re post

Last I checked Democracy didn't mean freedom.....Lookup these numbers.....How many people are in jail, homeless, people part of the trucking industry's 200% turn over rate.......basically the U.S. or any other country is not going to be able to force Democracy on any country......
Democracy is basically paying the same people that have money in a fast way over and over again and not spreading it throughout the world, or to the people that don't.......it also is the duck tape work made by congress of not fixing a problem just surrounding it with red tape.....and them (congress) going outside and humping rare sheep......

One ex: Is Oprah opening a American Idol school in Africa for strickly females.

First thing that happens one girl gets molested by teacher at school....
I wouldn't be suprised if the whole story wasn't made up to get money out of "the piggy bank" oprah...........

Nice deflection. However, the article says "an" inmate. And there have been MANY of such articles about MANY of the detainees we have released. Anyone who is intellectually honest and has critical thinking abilities can GOOGLE it and find the information. I only included ONE example.
Since he was a native of Algeria, where do you purpose we release them?

Sorry, but since those "quotes" say it far more succinctly than I can, you will just have to read the "quotes". Besides, if I hadn't "quoted" and included the links to my sources, you would be saying I just made it up. That is how intellectually dishonest democrat/socialist/independent/libertarians act.
