1,000 Trial Lawyers Block Reform for 300 Million Americans

Why Medical Malpractice Is Off Limits

A few thousand trial lawyers have a lock on Democrats, who refuse to consider any legal reform.

Eliminating defensive medicine could save upwards of $200 billion in health-care costs annually, according to estimates by the American Medical Association and others. The cure is a reliable medical malpractice system that patients, doctors and the general public can trust.
But this is the one reform Washington will not seriously consider. That's because the trial lawyers, among the largest contributors to the Democratic Party, thrive on the unreliable justice system we have now.
Almost all the other groups with a stake in health reform—including patient safety experts, physicians, the AARP, the Chamber of Commerce, schools of public health—support pilot projects such as special health courts that would move beyond today's hyper-adversarial malpractice lawsuit system to a court that would quickly and reliably distinguish between good and bad care. The support for some kind of reform reflects a growing awareness among these groups that managing health care sensibly, including containing costs, is almost impossible when doctors go through the day thinking about how to protect themselves from lawsuits.

Easy called make it so the LOSER pays ALL LEGAL FEES in any lawsuit. Tell you this that all these BS Cases would stop being filed including those for well I got a hangnail at the ER or the Doc gave me this scar from sewing me up to fast. Trust me the simple fact that you might have to pay MILLIONS IN LEGAL FEES WOULD HAVE TO STOP PEOPLE FROM FILING CASES.

Why not both? No group that I know of deserves it more. They are the ones that started the crazy increases in our health care costs in the 1st place.

Many of our pols in both parties are lawyers or are owned by them. What do you call a bus load of lawyers going over a cliff with 3 empty seats? A crying shame.

The president says we need a trial program. Mississippi has already done it. We reduced medical malpractice suits by 90 something percent the first year the law passed.

Of course, one of the big things we had to fix was the venue problem. We had lawsuits with hundreds of plaintiffs and ONE would be from the jurisdiction the lawsuit was filed in. They disallowed that and the "joining" (I believe is the correct term) of certain types of lawsuits, and put a cap on punitive damages (no cap on actual damages). viola! Lawsuits go down, we have doctors coming back.

Mississippi had gotten to where a lot of towns lost their last OB/Gyn because the medical malpractice insurance had gotten so high.

Didn't have any lawyers filing bankruptcy, did you? Still don't, they're just sueing in another jurisdiction. Put 'em on the bus.

That may be, but the president said we needed a trial program to see what works. Mississippi already "done did" that.

If you do a national reform similar to what Mississippi already did, you could drop the medical malpractice sharply. Granted, trial lawyers are smart, and they'll find some other area to be frivolous in, but we're talking medical right now.

Tort reform is not now, nor will it ever be a part of the bill. They are not interested in reform, goobernmint take over is the goal. More beaurocraps, more waste, which follows government programs/services like a shadow. At least 70% of every program is sucked up by the beaurocraps. Besides all that, this and most other things congress has done in the last 50 years is un-constitutional.
