The two cars executed a 'Swoop and Squat" scam. This is where the first car eases out in front of the big rig and the second car slides in between. Then the first car slams on the brakes so the second car gets rearended. First car disappears. Second car gets to claim being the victim. Remember all rear end crashes are the fault of the crasher automatically not the crashee. They targeted this truck driver because they could see he was on the phone and also in the wrong lane.
Who's at fault here?

I would rather take my foot of the gas and be on my way than sit by the side of the freeway exchanging paperwork, writing a report to my employer and dealing with the investigation and insurance companies.

One other point being the devil's advocate. We assume he saw what is in the video. I would probably contend that his dash cam is mounted high and center therefore it's field of view would be greater than the driver. It is possible he couldn't see the vehicle well. Granted he should have slowed. It is real easy to be an arm chair driver. Also we know he was on the phone what was the other party doing

did you actually see the video?? and if you did, did you see him move over..??
so please explain the high mounted camera, which IF IT WAS high mounted, then HE WOULD HAVE SEEN the car in the LOWER section of the window..???

I acknowledge that he saw the car. He did indeed move over she then moved back to her lane. And made the second attempt wich resulted in the collision.
I don't plan to be an investigator appears you are overly qualified for that position. I am just trying to point out things aren't always what they appear to be. -
Could it have been avoided I think it could have been.
You say he speed up to try and block her are you basing this on how fast he then came up on the other truck? How do you know the other truck did not slow down?
I say it was the car drivers fault. Failure to stay in establish lane & unsafe lane change. Just because they have the turn signal on does not give them the right to change lanes till it is clear & safe to do so.
