new policy on new drivers

    i was fired because i was out on doctors orders over 30 days..
    i was pissed but i was already there in murray before they told me i was fired(long story)
    anyways they told me i would have to ride with another guy for 30,000 miles.. EVEN THOU i was a safe driver there and before, and over 2yrs experance..
    this was going on for ALL new drivers at ptl... fresh rookies, or million mile drivers.
    if your hired on with ptl. you will spend 30,000 miles with a stranger in ther truck..
    needless to say i came home.. with the 1.5-2.3 miles i was lucky getting and having to rework my logs so bad to get them. i wasnt going for it

    I smell a good lawyer in your future. If you remained in contact with them during the 30 day period.

    Re-instatement with backpay based on your average salary. Might want to consider it...Lawyers love these kind of suits...quick cash for both of you.

    Many states are "at will " states . They can terminate you without even giving a reason . This is one benefit of unions . You have a contract to protect you .

    That's true..."at will".

    But there are exclusions. In their eagerness to lock a driver out of legal action. Many companies use a disclaimer that is signed at hiring. Stating that you are limited in your legal action, to bringing your lawsuit in a specific state. That can be a good thing. Especially if you have an honest Judge.

    Secondly, State law doesn't supercede Federal law. Especially where the the Family Medical Leave Act is concerned.

    It only takes about a half hour to find out. And many Lawyers will give a free consult.

    Nothing ventured, nothing gained.

    it is stated in there handbook that they will do that.. plus there in KY.. the commonwealth of KY might i add which can fire for any reason.. they listed me satfactory on my dac so im not complaining to much.. shame i lost $80 in gas driveing there and back.. i just thanks the lord i lived close

    i guess i was rasied to hate unions, living in the country and stuff. but now i see why unions can be a good thing. i mean your paying someone to speak for you and help protect your job right ? helping the little guy's voice come out and be heard to these big headed corporarte..ok ill stop there before i get banned.lol.:biggrin_25526:

    So what you're saying is...if I understand you correctly. You now see the use/purpose of having Union representation. But, you're unwilling to stand up for yourself, if Federal Law protects you?:biggrin_25512:

    State Law does not supercede the Family Medical Leave act, "At will" state or not. If that applies in this case.

    Otherwise they are free to do as they wish.

    i dont understand anything in this world. i guess a lawyer would be best to explain everything to me..
    oh, i was out on med leave becasue i fell outta the truck, then i was refused workers comp benfits.. :biggrin_25512:

    \My understanding is that a company still has to shoe "just Cause" even in a right to work or at will state.:biggrin_25511: PTL like most companies like most figure drivers won't stand up to them. I did so they fired me.:yes2557: Now they will have to show just cause as I go thru the unemployment system with them.:yes2557: They tried to get me to resign but i refused. They acted like their doing me a favor.:biggrin_25512: Stick to your guns. :biggrin_25516:Don't back down.:biggrin_25512: \t's better to die on your feet than live on your knees.:yes2557:
