    im not a new driver but didnt know where else to post this... i started with a company and have found out from the other drivers that the owner is charging us 30% of the fuel. i did not sign anything nor does it show up on our weekly pay stubs. is this legal? also i think he is paying some my 25% of the load by using the employer paid per diem...

    I'm no lawyer, but I think that might be an actionable position......unauthorized pay deductions are a big NONO! As for the "per-diem" thing, I'm not too sure about that, never had to deal with it. Only time I ever got it, it was in addition to my pay. (Which kinda sucked, as I needed it while I was away, not when I got home!)

    i would not pay for fuel for a company truck...never heard of this..i would look for another job

    the money has to show up, or not on your pay stub, why is it you can't figure it out?

    ??????? Time to find another job! A legitimate one! Go to the OOIDA website and do some researching to see what you can do about it. I was part of class action lawsuit against Mayflower because they were skimming drivers' fuel surcharge. The got nailed big time for it! Your situation sounds worse than that! Do something about it! Keep us posted.

    with 4 years of experience, can you tell whether or not the other drivers are pulling your leg...???

    as fulgrwmn said, compare your miles or hours to your pay stub....

    ask how many miles "such and such" run is paying....reset the trip meter on your truck, and compare those miles...

    keep a record...

    unless people sign papers stating such deductions are being made, then they are not legal deductions.....

    and i do not believe any labor dept will help you, they only enforce the minimum wage requirements....

    you would most likely have to seek legal counsel about charge backs to you..

    Truck companies can be very creative when it comes to paying the drivers. Deductions, service charges, fines, % of a %, escrow accounts, maintainence fee account, FSC not passed on.

    if your paid % of load, ive heard of guys getting paid after fuel was taken out, good way to screw someone over.

    if your a company driver you do not get any of the FSC on the load as part of the rate alot of company drivers think they are supposed to get the fsc as part of the haul rate , thats above the actual rate of pay, and to cover the extra fuel cost , as it comes and goes with prices . if your a O/O your to get 100% of that FSC , . , if your in question they have to tell you what the rate is on the load ( as they know when they take it ) then you divide by your earnig rate . if it don't match then you have skimming .
