Walk away. Right now. No.... RUN away. If they aren't taking any taxes out, it's only a matter of time before they just quit paying you altogether.

Ask me how I know that? :biggrin_25510:

Well, I was lucky on this breakdown - I was only down the street from the companies office.

When the wrecker finally came the boss told me to go with the wrecker to the repair shop because "it may be a quick fix" lol - even though I knew better, I was holding the yoke in my hand. (I waited there for 3 hours for the wrecker, decided to look in the tall grass on the side of the road for the missing part)

When we got to the repair shop, one of the mechanics came out, looked at the truck and said, "yeah, this will take at least until the end of the week"

So - I called the boss and told the the truck was out of service for the rest of the week, and that I only lived 10 minutes from the repair shop, so I called a friend of mine to pick me up and I went home.

The OP considered himself an employee, we don't know what the company considers him.

Your right, but those who sued lost and are still considered I/C's. If anyone should be consider an employee it would've been the FedEx drivers. They have to wear uniforms and paint their trucks white among some other things.

First off, being paid on a 1099 isn't illegal but in your case it may be?

From the sounds of things the people you are working for aren't in the best position so be careful so you don't lose any money or take a hit on your license/csa stuff.

Smartest thing you can do is go talk to someone who really knows the 1099 issue, not a bunch of truck forum lawyers. No offense to anyone posting!
