DMV trick question?

    I changed my out of state license at my DMV today but I found one of the question to be a little tricky:

    FOR COMMERCIAL DRIVER'S LICENSE ONLY
    Yes No 1. I certify that I do not have a driver's license from more than one State or jurisdiction.
    Yes No 2. I certify that I have read, understand and meet the qualification requirements under the Federal Rule 49 CFR, Part 391 of the Federal Motor Carrier Safety Administrations rules to operate a commercial vehicle.
    Yes No 3. I certify that I am not subject to the qualification requirements under the Federal Rule 49 CFR, Part 391 of the Federal Motor Carrier Safety Administrations rules to operate a commercial vehicle.
    Yes No 4. Are you subject to any disqualification listed in 383.51 of the Federal Motor Carrier Regulations?
    Yes No 5. Is the vehicle being operated on the driving skills test representative of the class for which you are applying and intend to operate?
    Yes No 6. Do you have a valid D.O.T. medical examiner certificate for a Class A, B, or C license?
    You must show the medical certificate as evidence and it must be updated every two years.
    Yes No 7. Are you a medically exempt government employee? If yes, give name of agency.

    3. No (Trick question?)
    4. No

    6. Yes
    7. No

    I found number 3 to be a little tricky, I mean am I not subject to the qualification requirements under the rules?

    I think I am subject to the qualification requirements under these rules in order to operate a commercial vehicle, right?

    Another thing about this question is that the words "not subject" is bold on the form.

    I asked the DMV guy about it and he told me that he doesn't know and I should know the answer to these questions.

    What do you guys think?

    Not being a trucker and it being several years since I looked at any of the paperwork, my common sense answer on that one is that question 3 refers to if you are subject to any sort of waivers or qualifications in order to get your license. For most people, the answer would be no.

    So did I answered it wrong? I'm not under any special medical condition and I don't need any waivers, and the question states that I certify that I am not subject to it, and I answered no, would there be any consequences for answering that question incorrectly?

    I had to update my address recently and came across this same question. My question was presented in true or false format by the SC DMV. [TABLE]

    I had a hard time deciphering exactly what the question was asking. I answered false to the question and left the DMV with an updated license, but I still am very unsure about my answer.
    I have to renew my CDL soon and ran across this post while doing research for how to answer the question next time I encounter it. When I asked the very rude DMV clerk what it was talking about, she just said that I should know how to answer the question and handed me a copy of the 49 CFR.
    Has anyone else had second thoughts about this question?
