I'm being accused of running over a stop sign at a shippers plant. I know I did not run the darned thing over because I saw my trailer clear it with my own eyes. That, and I took my truck into the oncoming lane a bit in order to make sure I had extra room. Another of my companies trucks left a few minutes after I did, I know because we ran on the highway together, and I saw him there when I left.
I'm positive that this is a case of mistaken identity but how do I prove this?
My company says there is nothing I can do, it's going on my record. Argh. I don't need or want an accident on my record.

first of all, i'd raise hell until they got so sick of hearing it, they might relent just to shut you up. if you are really sure it wasn't you - i'd ask if there were security cameras that may have caught it.

second, depending on how petty the company is, something like that may not even show up on DAC, and that's your only real worry. they probably aren't going to fire you, so as long as you work for them, there's no problem anyway.

should everything go wrong (the company sucks - you quit - they hang it on your DAC) i still don't think it will damage you much. this nonsense is all part of the deal - and most recruiters know it.

i was once hung with 2 preventables - it was the same accident (2 cars with very minor damage) - and i didn't even cause that. still the company refused to back off (i had the nerve to quit, which they hate) so it's on my DAC. i sent a rebuttal (which the okie idiots at DAC butcher into their own words) but it's worthless.

the good news is that most companies will listen to your side (i've had no problem finding work) and if they won't, you don't want that job anyway. if they are that rigid - think how they'll be on a day to day basis.

good luck and don't worry about it - fretting over this will take your mind off the important things and you may have a real accident.

There was an incident in Milwaukee where a trailer with our company logo was visible on a security cam and a stop sign was run over a short ways from there, the city couldn't prove it was our trailer that ran over it so it went nowhere.

DONT LET THEM PUT THIS ON YOUR RECORD.

Get a lawyer if necessary.

1. Tell your company, you want PROOF it was your trailer.

2. Tell your company, if they record this on your record with no proof, you will call a lawyer.

3. Call a lawyer.

Finally got a chance to stop and connect to the internet. Thanks for all the replies. I think I will take the lawyer advice. My boss wouldn't even give me the specifics of the accident. I.E. where were the witnesses (the sign is a football field away from the building and there was no one around, though they say there are witnesses that saw me), whether or not they just saw a company trailer or specifically my smiling face, or even how I can contact them. Apparently this is a new account and the shipper wasn't too happy so it looks like I'm being offered out as the sacrificial lamb since I'm the new guy.

I think my boss and I are going to have a nice little chat soon. Thanks again everyone, I won't take this laying down.
