I was talking to another driver the other day (which probably makes it not true) and he was telling me that if you get a DOT inspection either at a scalehouse/roadside/at a truck stop that as long as you close the curtain of your sleeper DOT cannot search that area without a warrant.
I have always been told that the 4th amendment doesn't apply to trucks
is this true?

It is a fact that if you leave your fleshlight on the floor between the seats, most LEO will almost barf and tell you to get on down the road
barroll, Pmracing, Rooster1291979 and 14 others Thank this. -
Dot or anyone else cannot search your vehicle with a search warrant or probable cause....PERIOD.
They will say something like, I need to get in your truck and take a look. That's when you say no. If they ask you to get out of your car or truck take the keys and lock the door behind you. -
US Marshalls will arrest any LEO attempting to do that to a driver...you can contact the local Marshall office and they will come ASAP.
** I had a driver tell me this happened to him in Effingham once**Dr_Fandango44, chalupa, 281ric and 1 other person Thank this. -
pretty sure i've had one before -
Also, there are many videos on Youtube about your rights and how to act under certain circumstances
Just do a search "your rights when stopped by police" -

A DOT inspection may include the bunk area while examining the HVAC system, which I think is pretty rare. It seems safe to assume most DOT officers do not want to find what they have previously found in truck bunks... but maybe that was just my bunk*.
Standard DOT inspections do not include "searches" for contraband. If the officer has probable cause to search, say, alcohol detection, they will place you under arrest if they need a warrant, which they probably do not. OTOH, if a law enforcement officer wants to search your truck, they're going to search your truck, if they have to lie and say you consented to it.
I am not a lawyer, so this can't be legal advice.
*That's joke, Son.Skate-Board, fuzzeymateo and Raiderfanatic Thank this. -
im a solo driver and i dont like using that bunk safety belt...
Skydivedavec, Skate-Board, Pmracing and 2 others Thank this. -
If you're logging time in a sleeper berth, a DOT officer may enter your sleeper to inspect it and make sure it complies with FMCSR 393.76. That being said, I HAVE had an officer enter my sleeper to inspect it during a level 1.
Skydivedavec Thanks this.
