Here's the story.. I was driving at night barely anybody on the road, two lane highway, I was in the right lane. All of a sudden a guy speeding drives right into my truck.
He does not slow down or turn away.. in fact he continues to steer into me and accelerate!
Then as he's grinding into my truck he drives into my left steer tire, my lug nuts cause is rear right tire to explode.
Again, doesn't slow down or turn away instead he decides to pass me and then plow into the right guard rail on the other side me of.
As crazy as all this sounds I have the pictures to prove it all if need be.
Obviously the driver fell asleep.
I stopped and did all the "right things".. but now I'm thinking it was dumb of me because there was no damage to my truck besides his paint and tire marks on my rim and now all this garbage is going to go on my record.
The state trooper told me it wasn't my fault and his record will state such however it's still going on my record.
My question ....
Is there ANYWAY I can remove a non at fault, not preventable accident off my record? and have no DOT Reportable accidents also.. I mean nothing nowhere!
I really don't want to be punished from a driver falling asleep behind the wheel.
Not at Fault accident question

Check your MVR regularly to make sure this was not put on you. Sounds to me like this won't be a problem as long as you were not cited. If it's listed as "non-at-fault" then it shouldn't be a factor on your license. BTW, you're required by law to stop in an accident regardless of who is at fault. Not stopping would certainly get you a hit and run and suspension of your license, not to mention a lawsuit from this idiot that hit you.Knucklehead619, gpsman, BrenYoda883 and 1 other person Thank this. -
Hopefully his report shows it wasn't your Fault.
I would get a copy of the report and keep it in your filling cabinet at home or something. -
I don't want this event to be something negative on my record that could prevent me from getting a better job in the future.
I see places with requirement "no DOT report accidents" and places always ask "accidents (even not at fault)".
Trying to keep my record clean is number 1 for me especially being I'm still somewhat of a noob.OPUS 7 Thanks this. -
Well that's the right attitude to have. I don't think you have to worry about at. You're out there every day, things happen, it's just the nature of the job. Focus on what you can control and not on what you cannot. -
In a word: No. It's there. The only thing you can do is make sure its on your record as a "non-preventable".

As a matter of fact in some states I believe you are required to stop and offer aid even if you aren't involved..
if you witness a accident and can offer aid,,we ALL should. -
