Husband/Wife Per Diem Question

I have done some searches on this and have a basic understanding of the advantages and disadvantages of accepting Per Diem.

However, there aren't many threads or posts that explain per diem for husband and wife team drivers that will be filing taxes together. Is it worse in this case to accept this rather than claim it on our taxes due to the Social Security contributions and lowering our Gross Income?

The company my husband and I are pre-hired with (starting school on Monday) pays .41 (team rookie pay) including per diem mileage of .04. I have not asked the recruiter if the .04 is split or for each of us yet. This amount seems well under the daily allowance pay, which I believe is $52 (or $57, I cant remember) a day. So this would be $104 a day out on the road, which we could claim 75%, is that correct?

Could we still claim the remaining amount of per diem not "paid," to us by our company? And if that is the case, what we have to do is save copies of our logs for proof rather than saving all of our receipts.

I will surely check with the tax accountant but just want to make sure I understand it a bit better before sounding like a dufus.

I'm glad that I checked this thread, I was just going to ask you about it-

I don't think that we are as much at risk because we aren't receiving the max per diem from company as some others. Some companies I have read are giving Solo drivers like 0.10-.12 a mile, this I believe is what really lowers your Gross.

However, my interpretation with 20 years of income tax preparation, I would say both are able to take the per diem.

Reason. If you were unrelated and were team drivers, both would be taking it. You are both drivers and therefore you should receive the benefit.
