| I was reading the FMCSA handbook about the HOS and I find no solice in what I've read. In the 100 mi radius you are exmpt from 395.1 as long as you are released from work within 12 hours, ok. Does this mean that I am also exempt from the 7/70 rule? This logbook is different and is no clearer than the handbook. I know I can work 14 hours but drive no more than 12?? Or can I only log the 12 hours? 395.1 (2) Emergancy conditions says I could complete the run without the emergancy, fellow driver ran out of fuel and needed to be primed, pull the fuel filter, fill and replace. I have this knowledge and was able to help but it took about an extra hour and a half, I logged about 13.5 hours that day, is this legal? Is this considered an emergancy? Any input here would be greatly appreciated! d55 |

| That's a good question and I think the FMCSA is the ONLY one that will give you a correct answer. The handbook does say you must report back to your location in 12 hours. That includes driving and working not driving. Forget the rule if you want to work 14 hours, you'd just have to run a log. The 7/70 requirement is a good question and my guess is that it would not apply since you're returning to your terminal but it's better to check and get the name of the person that gives you the ruling. |

| Not quite sure how they would prove when you started without a log. We don't have to run logs or fill out pre trip sheets here. But on the flip side, no one that I haul to is open more than 11 hours a day. Even if they were I couldn't get any material before 6am or after 4:30pm. Just gotta haul ### in between.
