Using truck for personal conveyance

    What's the difference between that and driving his car that was left at the terminal home after the same amount of time?

    The guidance simply states he is off duty and can log it as such since he has been relieved of all responsibility . Whatever a driver does off duty is no concern to the FMCSA .

    Well I got this this strait out of a State Troopers mouth. i asked him about it and he chuckled and said that it was a grey area. He said legally it was true that you could bobtail and say personal conveyance and be off duty, But he also said this if you are logged off duty and hit someone and kill them their lawyer will own you. Being that its not spelled out in black in white it won't hold up in court. He said that if you have enough hours to log on duty that is the best thing to do and only use this if absolutely needed and be very careful when doing so. As far as getting a ticket for it he said he wouldn't write one.

    Why would you need to go through the scale if you are on personal conveyance, there would be no need to go through the scale, BECAUSE YOUR ON PERSONAL CONVEYANCE!!!!!

    You hit it right on the nail, there is no difference, these regulations, notice I said regulations, not laws, in other words rules to the game that shouldn't be violated & if violated can, notice i said can, be cited not must be cited. To keep some sort of order in the game if you will, because everybody would be doing what ever they want to whenever they want to & most importantly it wouldn't give the cities, counties & states a way to make revenue, MONEY, YES THIS IS A MONEY GENERATOR, SO THEY HAVE TO HAVE SOME RULES THAT YOU WILL BE ABLE TO BREAK WHILE PLAYING THE GAME SO THAT THEY CAN CHARGE YOU A FEE OR FINE ALONG THE WAY!!!!

    That trooper really needs to know what they are speaking of before answering that kind of question. Provided you have NOT been put out of service and the company under who's authority you drive allows it all you would need in the event of an accident is a statement of fact from the FMCSA covering the legality of this. I know this because it happened to one of my cousins back in 2004. He was bobtailing from a receiver where he had did a drop, and was off duty and headed home. The distance covered was about 30 miles. A young girl actually hit him in the rear. He was charge with a logbook violation but that was tossed by the judge upon being showed statements from his company and the FMCSA that he was legal. There was an attempt to sue but that went nowhere once it was determined no laws had been violated. What you do want to be careful about is the state you might be in. The state might have something that prohibits this in Intrastate driving law. If you do drive a CMV this way a lot I suggest you contact your closest FMCSA regional office and get them to send you a letter, and contact your state about it.
