    Carriers must have your written authorization before they check your record with any third party information provider; like DAC services. This means you should always pay attention to the paperwork you sign when applying for employment. If they're going to check with DAC, or any other Consumer Reporting Agency for that matter, you should be aware of the information that the prospective employer is going to find out about you. As a Consumer Reporting Agency, DAC is regulated by the Fair Credit Reporting Act. The FCRA is designed to protect your rights whenever you apply for a job or credit. A few of your rights regarding DAC reports include:
    • The right to know who has seen your DAC report in the previous two years.
    • The right to obtain a copy of your DAC report at any time. In some cases (such as denial of employment due to DAC information) the report may be obtained free of charge.
    • The right to dispute any item on the report.
    Additionally, carriers are required to notify you of your right to review the information obtained from your previous employers. This provision applies regardless of whether or not this information is obtained directly or through a third party provider; like DAC Services. They're further required to inform you of your right to correct errors in that information; or to file rebuttal statements regarding verified, but potentially misleading, information.

    How do you get a copy of your report? Contact DAC Services at (800) 381-0645 and request information on obtaining your report. You'll probably need to request the report in writing due to security concerns and you'll want to include a copy of your driver's license and social security card. The address for DAC/USIS is:

    Once you receive the report, check it carefully for errors and negative entries. Chances are good that the information will be correct and positive but if it isn't, it's time to get hopping.

    DAC Services must also comply with the FACT Act; the Fair and Accurate Credit Transactions Act. Upon written request to USIS/DAC (or any similar reporting agency), under the provisions of FACTA, a driver's entitled to receive a free copy of their DAC report once every twelve months. Additional copies may be provided within the subsequent twelve month period; subject to a $9.50 charge. Other circumstances, such as being denied employment, may entitle a driver to additional free copies of their file information.     Dealing With Incorrect or Negative Information

    If an entry is incorrect, begin by contacting the employer that provided the information you believe to be incorrect. Chances are good they'll be willing to correct it immediately; especially if you left their employ on good terms. If not you'll need to contact DAC Services and formally dispute it. Normally, DAC will provide a dispute form with your report copy. If they didn't you can contact them and request one or write a letter stating your reason for disputing the information.
    When writting your dispute letter; be calm, courteous and professional. To be successful you must be specific and stick strictly to the facts in dispute. A copy will be forwarded to the company along with any other supporting documents you may have included (and, if at all possible, DO include supporting documents). If the previous employer can't verify the disputed item or items in question as being legitimate and correct then DAC is required, under the FCRA, to remove those items from your report. The previous employer has 15 days to respond to a driver's request for a correction of erroneous information.
    Within five days of the conclusion of the investigation into the dispute, you must be provided with a copy of the corrected report and may request to have the corrected report sent to anyone who has seen the incorrect report within the last six months.
    If the company is able to verify the information as correct it will not be removed from the report. In that case you'll be able to include a rebuttal statement on your report. This statement, the facts of the case as you see them, then becomes a permanent part of the record; allowing everyone who orders the report to read your side of the issue. If you, as a truck driver, choose to submit a rebuttal, and you've been denied employment based on your DAC report, your previous employer has 5 days to forward the rebuttal statement to the prospective employer and add a copy of the rebuttal statement to your permanent employment record.

    I drove for a fleet owner that had my truck with tri-state and other truck with landstar. Landstar truck afrter last november seemed to sit alot waiting for a load. Tristate was bad since first of year for sitting but landstar was worse.
    Tristate also changed deadhead on loads from 50 miles to 100 miles before the paid for deadheading.

    First off, hello everyone. Im new here.


    Im kind of new to the trucking industry, got only 2 years under my belt and I already seem to have ran into a problem.

    I was recently working for Sitton Motor Lines out of Joplin MO, and I always thought they were great and I truely enjoyed working for them and respected the company. But 2 weeks ago they are having hard times just like most companies and they pulled me into the yard for what was suppose to be getting the simple service done.

    But as I got there I noticed about 80 trucks sitting there (the company only had about 350 drivers) and they started the downsizing of the company. I knew I was one of them to be let go, but they inspected my truck and noticed I had a flat tire that wasnt there about 4 hours previously and damage to the fin that happend during winter which I did not report because I honostly didnt think it was a big deal.

    I ended up getting terminated for this, because it was against company policy. Now, I havent gotten a hold of my DAC report yet. And Im trying to convince myself that they didnt put that on there given the severity of how many drivers they are forced to get rid of and found an excuse for me. But what can happen if that does show up and everywhere I try to apply sees that?

    Go sign up for unemployment. Good jobs are few and far between. And the employment office is very well aware of these companies downsizing, and firing drivers for BS reasons. Most everyone that I know that has been fired are now collecting unemployment. Most likely you will have a preventable on your DAC & they are going to say you weren't truthful about it. Why didn't you get it fixed when it happened?

    Yeah, I signed up for unemployment. Still waiting on that, but I didnt bother getting it fixed because it only bent alittle bit when I was in a PA truck stop during a storm and got stuck and wiggled my way out of it. I didnt say anything because Ive seen alot of trucks with bent fins and no one said anything to me about it for 6 months when i would often go to the yard.

    Now I do realise I made a mistake, and am not mad at the company because I thought they were a great company and treated me with a high amount of respect. I talked to someone today and said they might have even put down that I quit instead of termination because of hurting me as a driver. I didnt get to explain what happend and it was over in less than 2 min.

    But if it does come up, will I be able to take my loss and still continue to move on and forward with a more local company without it being a major flaw?

    Any damage is a big deal. You don't report it and it just became a preventable, your fault, Failed to report. You can see how bad this looks.

    Here's your problem, Right now if you don't have a perfect record it's tuff to get hired on some place. The longer you are out of trucking the harder it will be to get back in. You have a mark on your DAC which says accident preventable. Which is no big deal. The problem is it also will say not reported. Which is a big deal.

    I know it may look bad to be fired, but if you say you quit, the company gets out of paying unemployment. If your fired for "not a just cause" they have to pay. You'll have to go through the phone call hearing, but most likely you'll get it. The money is paid from the state where your company paid you from. Which may not be the same as you live in. Which means the amount you are eligible to receive, may not be the same as your state. My state pays alot more, then the state I'm collecting from.

    I have just graduated a trucking school here in South Carolina. I just got a copy of my DAC report and it is clean. The question i have is this, I have a misdemeanor back in 2001 and it isn't shown on the DAC. When filling out applications should I disclose this information or not worry about it?
